The Public Service Labour Relations Board anticipates that subparagraph 209(1)(c)(ii) of the Public Service Labour Relations Act will be coming into force on December 31, 2005. This provision allows for the referral to adjudication of deployment grievances, in certain circumstances. Accordingly, the Board has been in the process of reviewing the Public Service Labour Relations Board Regulations (the Regulations) with a view to amending them to reflect the coming into force of this provision.

The amendments propose two changes of a technical nature to the Regulations:

  • Subparagraph 89(1)(a)(ii) will be amended to provide that deployment grievances are to be referred to the Board using Form 21; and
  • Form 21 will be amended to include deployment grievances

The Board would like to give all interested persons an opportunity to comment on the proposed amendments to the Regulations. Subject to any comments received, the amendments will be submitted to the Board for approval.

RE: Draft Amendments to Regulations

Effective October 3, 2005, the Public Service Labour Relations Board will issue summary orders (instead of formal ones) declaring positions to be managerial or confidential (M&C) positions where the bargaining agent does not object to an employer’s application for such a declaration (section 75 of the PSLRA). These summary orders will not be incorporated in the Board’s online decisions repertory.

The Board will continue to make formal orders in cases where the appropriate bargaining agent objects to an employer’s application for a declaration that any position is a managerial or confidential position.
