  Government's Response to the First Report of the Gomery Commission

Recovery of Funds

On March 11, 2005, the Government of Canada filed a Statement of Claim in the Quebec Superior Court against a total of 19 defendants (11 firms and 8 individuals) for $40.8M, related to the Sponsorship Program.

The Claim for the Recovery of Funds provided that it could be amended in the future if the Government acquired additional evidence that would support future claims.

The Claim was first amended on September 30, 2005 to refine the amounts previously claimed ($40.8M), remove claims that have been settled with three defendants (Paul Coffin, Communication Coffin and Groupe OSL Inc.(current owners of Publicité Martin)), and add new amounts ($7.8M) claimed from 13 of the original defendants.

The Claim was further amended on November 1, 2005 to add 12 new defendants and new amounts totalling $12.9M.

As a result of these amendments, the government is now claiming a revised total amount of $57M against 28 defendants (17 firms and 11 individuals). This amount does not include the $1.6M that has already been recovered through settlement agreements and the $1.1M remitted by the Liberal Party of Canada as a result of the findings of the Gomery Report.
