Information Bulletin - Final Implementation of an Act to amend the Copyright Act (Bill C-32)OTTAWA, September 1st, 1999 - By order of the Governor General in Council, the remaining provisions of An Act to Amend the Copyright Act (Bill C-32), will come into force on October 1, 1999. These provisions relate to ephemeral recording exceptions for broadcasters, and remedies for copyright infringement. The coming into force of these provisions completes the implementation of Bill C-32, which received Royal Assent on April 25, 1997.In particular, the order implements certain exceptions that will allow radio and television broadcasters to make temporary copies (ephemeral recordings) of performances of copyright works to facilitate programming and broadcasting operations. These exceptions are subject to certain conditions and limitations, including, for example, limits on the duration that the copies may be kept, and certain record-keeping requirements pertaining to the copies. The order also implements new remedies for copyright infringement. These are statutory damages, the "wide injunction" and the possibility of initiating summary proceedings in copyright infringement cases. The order and the regulations will be available in the Canada Gazette, Part II, on September 15, 1999.
