Review Tribunal
(Agriculture and Agri-food)
The Review Tribunal was established under the Canada Agricultural Products Act (CAP) and continued under the Agriculture and Agri-Food Administrative Monetary Penalties Act (AMP). The AMP Act assented to on December 5, 1995, establishes, as an alternative to the existing penal system and as a supplement to existing enforcement measures, a fair and efficient administrative monetary penalty system for the enforcement of the Agri-Food Acts, namely, the Health of Animals Act, Plant Protection Act, Pest Control Products Act and a few more.
Pursuant to the CAP Act, the Review Tribunal has been given the power to hear two (2) types of reviews:
- Reviews of Board of Arbitration decisions;
- Reviews of various Agencies' notices of violations. One must note that these reviews are limited to agencies who have chosen to utilize AMPs as an alternative enforcement measure.
