On May 14, 2001, Miriam Gallacher on behalf of Laura Patton filed, pursuant to subsection 172(1) of the Canada Transportation Act, S.C., 1996, c. 10, an application with the Canadian Transportation Agency (the Agency) regarding Royal Aviation Inc. (Royal). Subsequently, Royal was purchased by the parent company of Canada 3000 Airlines Limited (Canada 3000) and its commercial air services were merged with Canada 3000, with Canada 3000 being the surviving operation. As such, Canada 3000 is the appropriate respondent to this application at this time; however, on November 8, 2001, Canada 3000 ceased operations and subsequently made an assignment in bankruptcy.

While the Agency is committed to the elimination of undue obstacles in the federal transportation network and acknowledges the difficulties that you may have experienced with Royal, as a result of Royal and Canada 3000's current circumstances, the Agency is not in a position to order corrective measures against these carriers.

In light of the above, the Agency will not proceed with this application against Canada 3000 and hereby closes the file.
