Council of Canadians with Disabilities VIA Rail Canada Inc.

Re: Application by the Council of Canadians with Disabilities against VIA Rail Canada Inc.

By letter dated January 30, 2002, received on January 31, 2002, the Council of Canadians with Disabilities (CCD) filed its submission, with attachments to follow, in response to Canadian Transportation Agency (Agency) Decision No. LET-AT-R-11-2002 dated January 16, 2002. Although this submission was filed after the prescribed deadline of January 30, 2002, as set out in Decision No. LET-AT-R-11-2002, the Agency, pursuant to section 8 of the National Transportation Agency General Rules, accepts the submission as being relevant and necessary to its consideration of this matter.

The Agency, as part of its investigation into this matter, has determined that the following additional information is required to be filed by VIA Rail Canada Inc. (VIA):

1. VIA is to clarify the second footnote of Schedule A to its response to Question 7, as contained in its submission dated November 30, 2001. In particular, VIA is to confirm if it is spending $130 million to purchase 116 cars or 139 cars as had previously been indicated.

2. With respect to the tie-down to be provided in the Renaissance coach cars, VIA is to explain other alternatives it may have considered, as well as the related costs and resulting dimensions of the tie-down. For example, VIA is required to indicate whether it is feasible to rotate and lower the seats in the row in front of the tie-down location, and if so, to provide the costs for this option and the resulting dimensions of the tie-down space.

The above-requested information is to be filed with the Agency, with a copy to CCD, by  February 11, 2002. It should be noted that, as the Agency continues with its investigation, further interrogatories may be directed to CCD or VIA.
