This is further to P.F. Collins Customs Broker Ltd.'s application to the Minister of National Revenue for a licence to authorize the temporary importation of the above-mentioned vessel to offload, from the vessel STELLANOVA in Montréal, Quebec, three heavy pressure reaction vessels and ancillary equipment and to transport this cargo to Nanticoke, Ontario. On October 22, 2002, the Canadian Transportation Agency (the Agency), through Agency counsel, issued an oral decision in the above-referenced matter. The Agency thus advised the parties that it was of the opinion that no Canadian ship or non-duty paid ship is suitable and available to provide the service or perform the activity described in the application. Following the Agency's decision, an offer of a vessel from Ocean Transport Maritime Inc. was received on October 23, 2002. Given that this offer was filed after the deadline provided for in the Notice of Coasting Trade Application of October 18, 2002 and given the urgency of this matter, the Agency is rejecting this offer as being out of time. The reasons supporting such a finding will be issued shortly by the Agency. This determination was also provided to the Minister of National Revenue for any necessary action as provided for in the Coasting Trade Act. |
