IN THE MATTER OF an agreement between the Canadian National Railway Company (hereinafter the railway company), 1276343 Ontario Limited and the Corporation of the City of Welland pursuant to subsection 101(2) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), relating to the construction and maintenance of the road crossing and to the installation and maintenance of a crossing warning system at Woodlawn Road and mileage 8.17 Canal Spur, off mileage 20.90 Cayuga Subdivision, in the city of Welland, in the province of Ontario.

On January 17, 2000, the Canadian Transportation Agency (hereinafter the Agency) received a letter from the railway company dated December 21, 1999, which enclosed a copy of an executed Agreement entered into by the railway company, 1276343 Ontario Limited and the Corporation of the City of Welland with respect to the work set out in the title.

Pursuant to subsection 101(2) of the CTA, the above-noted Agreement becomes an order of the Agency authorizing the parties to construct or maintain the crossing, or apportioning the costs, as provided for in the Agreement.

Accordingly, pursuant to subsection 101(2) of the CTA, the above-noted Agreement is an Order of the Agency as of January 17, 2000.
