Use of frequency 93.3 MHz with the low-power tourist information
service in Fredericton

1. |
The Commission approves the
application by 3077457 Nova Scotia Limited in order to operate its
English-language low-power FM radio programming undertaking at 93.3 MHz
(channel 227LP) with an effective radiated power of 50 watts. The
applicant had originally proposed to operate its new station at 93.1 MHz
(channel 226LP) with an effective radiated power of 50 watts. |

The applicant filed this application further
to the Commission’s direction in Low power tourist information
service in Frederiction, Broadcasting Decision CRTC 2004-524,
26 November 2004 (Decision 2004-524).
In Decision 2004-524, the Commission
stated that it would only issue a licence for this station provided
that the applicant submitted an application proposing the use of another
FM frequency that would be acceptable to both the Commission and to
the Department of Industry (the Department). |

The Commission received one intervention in
support of this application. |

The Department has advised the Commission
that, while this application is conditionally technically acceptable, it
will only issue a broadcasting certificate when it has determined that
the proposed technical parameters will not create any unacceptable
interference with aeronautical NAV/COM services. |

The Commission reminds the licensee that,
pursuant to section 22(1) of the Broadcasting Act, this authority
will only be effective when the Department notifies the Commission that
its technical requirements have been met, and that a broadcasting
certificate will be issued. |

Given that the technical parameters
approved in this decision are for a low-power unprotected FM service,
the Commission also reminds the licensee that it will have to select
another frequency if the Department so requires. |
