PREAMBLE |

For items 1 to 18 |
|
On 13 May 2005, the Commission
issued Broadcasting Public Notice CRTC 2005-48,
calling for applications for a broadcasting licence to carry on a
radio programming undertaking to serve Calgary, Alberta. |
|
As well, on 14 July 2005, the
Commission issued Broadcasting Public Notice CRTC 2005-67,
calling for applications for a broadcasting licence to carry on a
radio programming undertaking to serve Lethbridge, Alberta. |
|
Further to both calls, the
Commission has received a significant number of applications for
licences to serve the aforementioned markets (Items 1 to 18). A number
of these applications are proposing to use similar frequencies and are
therefore technically mutually exclusive. |
|
a) Calgary market
technically mutually exclusive applications: |
|
Items 3, 4, 5, 7, 9 and 10 are
technically mutually exclusive proposing the use of the frequency
92.9 MHz. |
|
Items 11 and 12 are technically
mutually exclusive proposing the use of the frequencies 99.1 MHz and
99.5 MHz respectively. |
|
Items 8 and 13 are technically
mutually exclusive proposing the use of the frequency 100.3 MHz. |
|
These applications along with
items 11 (use of the frequency 106.1 MHz), 1, 2 and 6 will be treated as
competitive radio applications for the Calgary market. |

b) Lethbridge market
technically mutually exclusive applications: |

Items 15, 16 and 17 are
technically mutually exclusive proposing the use of the frequency
94.1 MHz. |

These applications along with
items 14 and 18 will be treated as competitive radio applications for
the Lethbridge market. |

The Commission intends to
consider, subject to interventions, items 19 to 39 during the
non-appearance phase of the public hearing. |

246LP) to 98.1 MHz (channel 251B) and to change the authorized
contours by increasing the effective radiated power from 50 watts to
20,000 watts, by increasing the antenna height and by relocating the
transmitter (non-directional antenna/antenna height 174.3 metres).

The applications are
non-severable. |
|
The value of the transaction is
estimated at $225,000. No tangible benefits have been proposed by the
applicant. |
|
The applicant is requesting a
licence to continue the operation of this undertaking upon surrender of
the current licence issued to Spirit, and confirms that it would adhere
to the conditions of licence currently in place for CJTS-FM as set out
in Decision
CRTC 2000-743. |
|
The Commission notes that the
authorized contours of the station will increase significantly as a
result of the technical changes. The Commission also notes that the
increase in power will result in a change of CJTS-FM status from a low
power unprotected service to a Class B protected service. |

national ethnic specialty programming undertaking to be known as German
TV. |

The applicant states that the
programming will be dedicated to the German-speaking community. |
|
The applicant proposes to offer
programming from the following categories: 1, 2(a), 2(b), 3, 4, 5(b),
6(a), 6(b), 7(a), 7(b), 7(c), 7(d), 7(e), 7(f), 7(g), 8(a), 8(b), 8(c),
9, 10, 11, 12, 13 and 14 as set out in Schedule I of the Specialty
Services Regulations, 1990. |

The applicant proposes to
broadcast not less than 90% of its programming in the German language.
The applicant requests the authority to broadcast up to 6 minutes per
hour of local or regional advertising.
The proposed condition of licence would read as follows:
(a) Except as provided in paragraph b) and c), the licensee shall
not distribute more than 12 minutes of advertising material during
each clock hour, of which no more than 6 minutes may consist of local
or regional advertising.

Before initiating service
through electronic mode, please ensure that you will be able to satisfy
the Commission, upon request, that service of the notification was
completed. |

Where the intervention is filed

following the last paragraph of the document, as an indication that the
document has not been damaged during electronic transmission. |

Each paragraph of the document
should be numbered. |

Your intervention should
clearly identify the application and indicate whether you support or
oppose the application, or if you propose changes to it, include the
facts and grounds for your proposal. |

In the event that the
application is brought to the oral phase of the hearing, and if you wish
to appear, you must provide reasons why your written comments are not
sufficient and why an appearance is necessary. |

Persons requiring
