Further to its Broadcasting Notice of Public
Hearing CRTC 2004-10 dated 3 November 2004
relating to a Public Hearing which will be held on 10 January 2005 at 9:00
a.m, at the Commission Headquarters, 1 Promenade du Portage, Gatineau,
Quebec, the Commission announces that it will also consider the following
application. The interventions/comments deadline is 16 December 2004.

Application by Durham Radio Inc. (Durham)
relating to the licence of radio programming undertaking CKDO Oshawa. |
|
The licensee proposes to operate its new FM
transmitter at Oshawa on frequency 107.7 MHz (channel 299A1) with an
effective radiated power of 250 watts (non-directional antenna/antenna height
of 70 metres). |
|
In Broadcasting Decision CRTC 2004-362
CKDO Oshawa – New transmitter in Oshawa, the Commission
approved in part the application by Durham for authority to operate
an FM transmitter of CKDO Oshawa, in Oshawa. The Commission, however,
did not approve Durham’s proposed use of frequency 107.7 MHz as the
proposal was technically mutually exclusive with a proposal by Rock
95 Broadcasting (Barrie – Orillia) Ltd., licensee of CKMB-FM Barrie. |

Accordingly, the licensee was required to submit
for approval an application proposing the use of a suitable frequency other
than 107.7 MHz. |
|
Industry Canada has since notified the
Commission that frequency 107.7 MHz is technically not suitable for use by
CKMB-FM Barrie as the proposal by Rock 95 Broadcasting (Barrie – Orillia)
Ltd. could cause unacceptable interference to aeronautical NAV/COM services. |
|
As a result, Durham is re-applying to use
frequency 107.7 MHz for its new FM transmitter at Oshawa. |
|
It is noted that Industry Canada has indicated
that the Durham application is technically acceptable and that a Broadcasting
Certificate will be issued subject to the necessary coordination with the
aeronautical NAV/COM services authority. |

The Commission advises those who file and serve

has occurred. |

Before initiating service through electronic
mode, please ensure that you will be able to satisfy the Commission, upon
request, that service of the notification was completed. |

Where the intervention is filed by electronic
means, the line ***End of document*** should be entered following the last
paragraph of the document, as an indication that the document has not been
damaged during electronic transmission. |

Each paragraph of the document should be
numbered. |

Your intervention should clearly identify the
application and indicate whether you support or oppose the application, or if
you propose changes to it, include the facts and grounds for your proposal. |

In the event that the application is brought to
the oral phase of the hearing, and if you wish to appear, you must provide
reasons why your written comments are not sufficient and why an appearance is
necessary. |

the public hearing so that the necessary arrangements can be made. |
