The Commission will hold a
public hearing commencing on 21 March 2005 at 9:00 a.m., at the
Commission Headquarters, 1 Promenade du Portage, Gatineau, Quebec,
to consider the following applications. The deadline for submission of
interventions/comments is 24 February 2005. |

relating to the licence of radio programming undertaking CKLY-FM City of
Kawartha Lakes (Lindsay). |

The licensee proposes to
change the authorized contours by decreasing the average effective
radiated power from 14,000 to 5,270 watts (maximum effective radiated
power from 27,500 to 11,400 watts/antenna height from 45 to 131 metres)
and by moving the antenna to a new tower at the existing transmitter
site. |
|
The licensee advised that under
municipal restructuring, the County of Victoria and 16 local
municipalities, including Lindsay, amalgamated to become the City of
Kawartha Lakes. The licensee further stated that the proposed changes
will result in a better quality signal to listeners located in the City
of Kawartha Lakes. |
|
The Commission will only

Application by Aylmer and
Area Inter-Mennonite Community Council to amend the licence of
radio programming undertaking CHPD-FM Aylmer. |

The licensee proposes to amend
the licence by changing the frequency from 107.7 MHz (channel 299LP) to
105.9 MHz (channel 290A1). |
|
The licensee also proposes to
change the authorized contour by increasing the effective radiated
power from 50 to 250 watts (non-directional antenna/antenna height
41.8 metres). |
|
The licensee wishes to increase
the coverage area of the station in order to provide the signal to the
public that cannot receive the signal. The change in contour will also
improve the quality of the signal of the station. |
|
The Commission notes that the
contour of the station would be increased significantly and that the
increase in power would result in a change of CHPD-FM’s status from an
unprotected low power service to a regular Class A1 FM station. |
|
The Commission will only
proceed with this application at the public hearing if advised by the
Department of Industry, at least twenty days prior to the hearing, that

band to the FM band. |

The new station would operate
on frequency 107.9 MHz (channel 300A) with an average effective radiated
power of 1,030 watts (maximum effective radiated power of
1,450 watts/antenna height of 203 metres). |
|
The applicant is requesting
permission to simulcast the programming of the new FM station on CHUC
for a period of up to 6 months from the date of implementation of the
new station. |
|
The applicant is also
requesting, pursuant to sections 9(1)(e) and 24(1) of the Broadcasting
Act, the revocation of the licence of CHUC effective at the end of the
simulcast period. |
|
The Commission will only
proceed with this application at the public hearing if advised by the
Department of Industry, at least twenty days prior to the hearing, that
it is technically acceptable. |
|
This application requires the
issuance of a new licence. |
|

The applicant is proposing a
classic hits based on adult contemporary music format. |
|
Subject to the approval of the
new FM station at Whitecourt, the applicant also proposes to amend the
licence of CJYR Edson by deleting the transmitter CFYR-FM Whitecourt. |
|
The applicant is currently
licensed to operate CFYR-FM Whitecourt as a transmitter of CJYR Edson. |
|
The Commission notes that the
new station would operate under the same technical parameters as
presently approved for CFYR-FM Whitecourt. |
|

during broadcast year 2000-2001 the licensee was in apparent breach of
sections 4(6) and 4(7)(b) of the Television Broadcasting Regulations,
1987 that require a licensee to devote not less than 60% of the
broadcast year and not less than 50% of the evening broadcast period to
the broadcasting of Canadian programming. |
