(Newcap) to amend the licence of radio
programming undertaking CKXX-FM Corner Brook, Newfoundland and Labrador. |

The licensee proposes to amend
the licence by changing the frequency of its transmitter CKXX-FM-1
Stephenville from 95.3 MHz (channel 237LP) to 95.9 MHz (channel 240A1).
The licensee also proposes to change the authorized contours by
increasing the effective radiated power from 12 to 234 watts and
by decreasing the antenna height from 118.2 to 103.4 metres. |

The licensee states it received
a letter from the Canadian Broadcasting Corporation (CBC) concerning a
new transmitter facility in Stephenville. The CBC indicated that this
new transmitter would create heavy interference with Newcap’s
unprotected transmitter CKXX-FM-1. CBC also advised that CKXX-FM-1’s
current parameters would create interference with its new transmitter. |

The Commission notes that CBC’s
new transmitter facility has been approved in Broadcasting Decision
CRTC 2005-48,
dated 9 February 2005. |
|
The Commission notes that the
increase in power would result in a change of the CKXX-FM-1’s status
from a low power unprotected service to a regular Class A1 FM station. |

relieved, by condition of licence, of the requirement pursuant to
section 25 of the Broadcasting Distribution Regulations not to
distribute the signal of CFTU-TV Montréal (Canal Savoir) and "l’Assemblée
nationale" on a restricted channel. |

If approved, Vidéotron would be
allowed to distribute these signals on a restricted channel, which could
result in a loss in picture quality. |

extension until 2 February 2006, to complete the construction and
commence the operation of the new transmitter. |

The applicant states it is
awaiting grant financing from the Northern Native Broadcast Access
Program of the Department of Canadian Heritage and from the Community
Places Program of the Department of Manitoba Culture, Heritage and
Tourism. |

The current application
represents the fifth request for an extension of time. |
|
The Commission approved the
first request for an extension of time from 3 February 2001 to 2 February
2002 in a letter dated 26 January 2001; the second request for an
extension of time to 2 February 2003 was approved in Broadcasting
Decision CRTC 2002-63,
dated 4 March 2002; the third request for an extension of time
to 2 February 2004 was approved in Broadcasting Decision CRTC 2003-163,
dated 23 May 2003; and the fourth request for an extension of time
to 2 February 2005 was approved in Broadcasting Decision CRTC 2004-176,
dated 12 May 2004. |
