FM transmitter at Yarmouth to broadcast the programming of CBAX-FM
Halifax, in order to serve the population of Yarmouth. |

The transmitter would operate
on frequency 106.1 MHz (channel 291B) with an average effective radiated
power of 20,500 watts (maximum effective radiated power of
54,500 watts/antenna height of 171.6 metres). |

Community radio station in Bécancour and Nicolet. |

The licensee proposes to amend
the licence of CKBN-FM Bécancour by changing the frequency from 90.5 MHz
(channel 213C1) to 88.1 MHz (channel 201B). The licensee also proposes
to change the authorized contour by decreasing the average
effective radiated power from 34,000 watts to 2,600 watts, by increasing
the antenna height and by relocating the transmitter (maximum effective
radiated power of 5,400 watts/antenna height of 262.4 metres). |

The licensee wishes to upgrade
its coverage and avoid interference with the existing stations. |

The Commission notes the
apparent failure of the licensee to comply with the condition of licence
relating to Category 3 music (Traditional and Special Interest). |
|
Background of non-compliance
by CIHO-FM |
|
Since 1989, the Commission
notes that the licensee has been found to be in non-compliance on four
occasions: |
|
- in 1989, short-term renewal (thirty-two months) due to
non-compliance relating to the broadcast of locally-produced
programming and to Category 3 music;
|
|
- in 1992, two-year renewal due to non-compliance relating to
logger tapes and to Category 3 music;
|
|
- in 1994, two-year renewal due to non-compliance relating to
logger tapes. The Commission issued a mandatory order concerning the
logger tapes; and
|
|
- in 1996, two-year renewal due to non-compliance relating to
Canadian Content for Category 3 music. The Commission issued a
mandatory order concerning Category 3 music.
|
|
In 1998, the licensee proved
that it was in full compliance and the Commission renewed the licence
for a seven-year term. |

antenna/antenna height 43.1 metres). |

The licensee indicates that the
increase is part of the normal development of the station in pursuing
its mission to serve the students of l’Université du Québec in
Trois-Rivières.

station will be increased significantly resulting from the
proposed changes. |

(CICO-TV-55) and Spragge (CICO-TV-62) presently broadcasting the
programming of CICA-TV Toronto. |

The municipalities currently
have agreements with TVOntario regarding the installation and
maintenance of transmitting equipment on municipal property. It has been
noted by each municipality, however, that the regions are adequately
served by the prevalence of cable and satellite services negating the
need for the transmitting facilities. Therefore, the municipalities have
requested TVOntario to remove their respective transmitters from
municipal lands. |
