Use of frequency 104.7 MHz by the new low-power tourist information
service in Ottawa

The Commission approves the
application by 3077457 Nova Scotia Limited, a corporation jointly
controlled by Jack McGaw and Robert Stapells, in order to operate its
new English-language low-power FM radio programming undertaking at
104.7 MHz (channel 284LP) with an effective radiated power (ERP) of 18
watts. The applicant had originally proposed to operate its new station
at 96.5 MHz (channel 243LP) with an ERP of 18 watts. |

The applicant filed this application further
to the Commission’s direction in Low power English-language tourist
information service in Ottawa, Broadcasting Decision CRTC 2005-256,
23 June 2005 (Decision 2005-256). In
Decision 2005-256, the Commission stated
that it would only issue a licence for this station provided that
the applicant submitted an application proposing the use of another
FM frequency that would be acceptable to both the Commission and the
Department of Industry (the Department). |

The Commission did not receive any
interventions in connection with this application. |

The Department has advised the Commission
that, while this application is conditionally technically acceptable, it
will only issue a broadcasting certificate when it has determined that
the proposed technical parameters will not create any unacceptable
interference with aeronautical NAV/COM services. |

The Commission reminds the licensee that,
pursuant to section 22(1) of the Broadcasting Act, this authority
will only be effective when the Department notifies the Commission that
its technical requirements have been met, and that a broadcasting
certificate will be issued. |

Given that the technical parameters
approved in this decision are for a low-power unprotected FM service,
the Commission also reminds the licensee that it will have to select
another frequency if the Department so requires. |
