Application by the Canadian
Broadcasting Corporation (CBC) to amend the licence of the
national Category 1 specialty programming undertaking known as Country
Canada. |

The licensee proposes to amend the
following portion of the condition of licence 1a) which reads: |
|
No more than 10% of all programming broadcast during each broadcast week
shall be devoted to subcategories 6a and 6b.
|

with the following: |
|
No more than 10% of all programming broadcast during each broadcast
year shall be drawn from subcategories 6a and 6b.
|
|
The licensee indicated that approval
of the proposed amendment would provide Country Canada with the flexibility
to more effectively schedule event-based sports programs and improve the
attractiveness of the service to subscribers while maintaining the same
amount of sports that is permitted to be broadcast throughout the year. |
|
The applicant is further requesting
to amend another portion of condition of licence 1 a) in order to remove the
reference to Country Music Television (CMT). |
|
The licensee stated that the
reference to the Corus-owned service CMT was appropriate at the time of the
original licensing decision as Corus maintained a 70% ownership interest in
Country Canada. However, pursuant to Broadcasting Decision CRTC 2002-336,
Transfer of effective control of 3899071 Canada Inc., 24 October 2002,
Corus transferred all of its shares in Country Canada to CBC. As a result,
CBC owns and controls the licensee so therefore, the reference to CMT in the
nature of service condition of licence is no longer relevant or necessary. |

The licensee proposes using a
Subsidiary Communications Multiplex Operations (SCMO) channel to broadcast
predominantly Punjabi, Hindi, Urdu, Bengali, Tamil and Sinhalese-language
programming. Programming broadcast using an SCMO channel is not accessible
with standard radio equipment and requires the use of a special receiver. |

This new service would replace a
Tamil-language radio service approved in Decision CRTC 99-203, New
Tamil-language SCMO service. |

undertaking CIWV-FM Hamilton/Burlington. |

The licensee proposes to change the
authorized contours by increasing the average effective radiated power from
11,390 watts to 21,400 watts (maximum effective radiated power of 45,000
watts/ antenna height of 136.1 metres). |
|
The licensee indicated that the
proposed change would improve service to listeners in its prime market of
Hamilton/Burlington and surrounding areas, particularly the western and
northern parts of the City of Hamilton and in north-east Burlington. As well
it would maximize the use of frequency 94.7 MHz while respecting the
interference protections to other Canadian and U.S. stations. |

The authorized contours of the
station will be increased significantly resulting from the proposed
increase in power. |
