REGULATIONS RESPECTING THE FEES PAYABLE FOR THE

INSPECTION OF SHIPS AND OTHER VESSELS

Short Title

1. These Regulations may be cited as the Board of Steamship Inspection Scale of Fees.

Interpretation

2. In these Regulations,

"Act"

«Loi»

"Act" means the Canada Shipping Act;

"Administration"

«Administration»

"Administration", in respect of ship's equipment, means the Government of the State whose flag the ship is entitled to fly;

"certificate"

«certificat»

"certificate" means any certificate issued pursuant to section 318 or 319 of the Act;

"first inspection"

«première inspection»

"first inspection" includes all inspections of a ship made by an inspector prior to the issuance of the first certificate in respect of that ship;

"inspector"

«inspecteur»

"inspector" means a steamship inspector appointed under the Act;

"length"

«longueur»

"length" means

(a) in the case of a ship that is registered under the Act or required by the Act to be registered,

(i) the distance from the fore part of the uppermost end of the stem to the aft side of the head of the stern post, except that if a stern post is not fitted to the ship the measurement shall be taken to the foreside of the head of the rudder stock,

(ii) if the ship has no rudder stock or has a rudder stock situated outside of the hull at the stern, the distance from the foreside of the foremost permanent structure to the aft side of the aftermost permanent structure of the ship not including guards or rubbing strakes, or

(iii) if the ship is double-ended, the distance from the aft side of the forward rudder stock to the foreside of the after rudder stock, and

(b) in the case of a ship other than a ship described in paragraph (a), the horizontal distance measured between perpendiculars erected at the extreme ends of the outside of the hull;

"non-Canadian ship"

«navire non canadien»

"non-Canadian ship" means a ship registered elsewhere than in Canada;

"Safety Convention Certificate"

«certificat selon la Convention de sécurité»

"Safety Convention Certificate" means a certificate issued under the provisions of the International Convention for the Safety of Life at Sea, 1974.

Application

3. These Regulations

(a) except Part III, apply in respect of Canadian ships; and

(b) apply in respect of non-Canadian ships.

PART I

GENERAL

Payment of Fees

5. The fees set out in these Regulations in respect of services performed by the Marine Safety Branch of the Department of Transport under Part V or Part XV of the Act or regulations made pursuant to those Parts shall be paid to any officer of that Branch.

Proportionate Fees

6. When a ship is inspected at any time within a period of 12 months after the date of the last annual inspection, a new certificate valid for 12 months may be issued upon the payment by the owner of the ship of one-twelfth of the appropriate annual fee for that ship, as specified in section 11 or 12, for each month or part thereof that has elapsed since the date of the last annual inspection.

Extension

8. A fee of $100 is payable for the extension of a short-term certificate or a letter of compliance, other than a letter of compliance referred to in column I of item 7 or 8 of the table to section 30, in relation to an inspection referred to in any of sections 10 to 14, 24, 30, 31 and 34.

Inspections Outside Canada

9. In addition to any expenses payable under section 313 of the Act, the fee payable for inspection of a ship outside Canada is an amount equal to the total of

(a) the appropriate fee for each survey, inspection or service referred to in sections 10 to 14, 24, 25, 28 to 31 and 34; and

(b) $400 for each day, or part thereof, that an inspector is outside Canada to make the inspection.

PART II

FIRST INSPECTIONS, RE-INSPECTIONS
AND PERIODICAL INSPECTIONS

First Inspection

10. (1) The fee payable for the first inspection of a ship of less than 25 tons, gross tonnage, is an amount equal to $286 plus:

(a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, twice the fee set out in column II of that item;

(b) for a non-passenger ship, other than a ship referred to in paragraph ( c ), having a gross tonnage set out in column I of an item of Table II to section 11, twice the fee set out in column II of the item; or

(c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, the fee set out in column II of the item.

(2) The fee payable for the first inspection of a ship of 25 tons, gross tonnage, or more, is an amount equal to $1,152 plus:

(a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, twice the fee set out in column II of that item;

(b) for a non-passenger ship, other than a ship referred to in paragraph ( c ), having a gross tonnage set out in column I of an item of Table II to section 11, twice the fee set out in column II of the item; or

(c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, the fee set out in column II of the item.

Re-inspection

10.1 (1) The fee payable for the re-inspection of a ship of less than 25 tons gross tonnage that was registered in Canada, then registered elsewhere than in Canada and is then again registered in Canada, is an amount equal to $286 plus:

(a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, one and one-half times the fee set out in column II of the item;

(b) for a non-passenger ship, other than a ship referred to in paragraph ( c ), having a gross tonnage set out in column I of an item of Table II to section 11, one and one-half times the fee set out in column II of the item; or

(c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, three quarters of the fee set out in column II of the item.

(2) The fee payable for the re-inspection of a ship of 25 tons gross tonnage or more that was registered in Canada, then registered elsewhere than in Canada and is then again registered in Canada, is an amount equal to $1,152 plus:

(a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, one and one-half times the fee set out in column II of that item;

(b) for a non-passenger ship, other than a ship referred to in paragraph ( c ), having a gross tonnage set out in column I of an item of Table II to section 11, one and one-half times the fee set out in column II of the item; or

(c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, three quarters of the fee set out in column II of the item.

Periodical Inspection of Self-Propelled Ships

11. (1) The fee payable for each annual, quadrennial or quinquennial inspection of a self-propelled ship that is subject to annual inspection, subsequent to the first inspection, is

(a) where the ship is a passenger ship having a gross tonnage referred to in an item set out in Column I of Table I to this section, the amount set out for that item in Column II of that Table;

(b) where the ship is a non-passenger ship having a gross tonnage set out in column I of an item of Table II to this section,

(i) the fee set out in column II of that item, or

(ii) where the inspection is solely in respect of parts of the ship other than items referred to in subsection 5(2) of the Classed Ships Inspection Regulations, 1988, the lesser of one-half of the fee set out in column II of that item and $770.

(2) The fee payable for each quadrennial or quinquennial inspection of a self-propelled ship that is not subject to annual inspection, subsequent to the first inspection, is

(a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to this section, twice the fee set out in column II of that item; or

(b) for a non-passenger ship having a gross tonnage set out in column I of an item of Table II to this section,

(i) twice the fee set out in column II of that item, or

(ii) where the inspection is solely in respect of parts of the ship other than items referred to in subsection 5(2) of the Classed Ships Inspection Regulations, 1988, the lesser of one-half of the fee set out in column II of that item and $770.

(3) The fees calculated in accordance with subsection (1) or (2) shall be rounded to the nearest whole dollar or, if the amount is equidistant from two whole dollars, to the higher thereof.

Periodical Inspection of Non-Self-Propelled Ships

12. (1) The fee payable for each annual, quadrennial or quinquennial inspection of a non-self-propelled ship that is subject to annual inspections, subsequent to the first inspection, is

(a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, one-half of the fee set out in column II of that item; or

(b) for a non-passenger ship, other than a ship referred to in paragraph ( c ), having a gross tonnage set out in column I of an item of Table II to section 11, one half of the fee set out in column II of the item; or

(c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, one half of the fee set out in column II of the item.

(2) The fee payable for each quadrennial or quinquennial inspection of a non-self-propelled ship that is not subject to annual inspections, subsequent to the first inspection, is

(a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, the fee set out in column II of that item;

(b) for a non-passenger ship, other than a ship referred to in paragraph ( c ), having a gross tonnage set out in column I of an item of Table II to section 11, the fee set out in column II of the item; or

(c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, one half of the fee set out in column II of the item.

(3) The fees calculated in accordance with subsection (1) or (2) shall be rounded to the nearest whole dollar or, if the amount is equidistant from two whole dollars, to the higher thereof.

13. Notwithstanding paragraphs 12(1)(b) and (2)(b), the fee payable in respect of each annual, quadrennial or quinquennial inspection, subsequent to the first inspection, of a non-passenger, non-self-propelled ship having a gross tonnage set out in column I of an item of the table to this section, where the ship is not subject to periodical inspection of the hull, is the fee set out in column II of that item.

PART III

INSPECTION OF NON-CANADIAN SHIPS

General

14. (1) Subject to subsection (2), where the inspection of a ship that is subject to the Coasting Trade Act is requested for the issuance of a letter of compliance, the fee payable is

(a) for the first inspection, the amount specified in section 10 for that ship; and

(b) for a periodical inspection or partial inspection, the fee specified in section 11 or 12 for that ship.

(2) Where a ship is authorized to operate in the coasting trade and is in full compliance with the requirements of the International Maritime Organization (IMO) Conventions to which Canada is a signatory and its period of operation is seven days or less, the fee prescribed in paragraph (1)( a ) or ( b ) is reduced by 90 per cent.

Issue of Safety Convention Certificates

15. (1) Subject to subsections (2) and (3), where inspection of a non-Canadian ship is requested for the purpose of obtaining a Safety Convention Certificate, the fee is as specified in section 11 for that ship.

(2) Subject to subsection (3), where inspection of the life saving equipment, fire extinguishing equipment, lights and sound signals of a non-Canadian ship is requested for the purpose of obtaining a Cargo Ship Safety Equipment Certificate only, the fee for that inspection is

(a) for a ship not over 1,600 tons, gross tonnage $1,000

(b) for a ship over 1,600 but not over 3,000 tons, gross tonnage 1,500

(c) for a ship over 3,000 tons, gross tonnage 2,000

(3) Where an inspection referred to in subsection (1) or (2) is made concurrently with an inspection referred to in section 14, no fee shall be charged for the inspection referred to in this section.

Extension of Safety Convention Certificates

16. A fee of $1,000 is payable for an inspection of a non-Canadian ship made for the purpose of extending a Safety Convention Certificate.

Authorization for Clearance

17. A fee of $1,000 is payable for each visit that is made by an inspector, where

(a) an inspection is required for the purpose of obtaining authorization for clearance for a non-Canadian ship to proceed on a voyage from any place in Canada;

(b) the inspection is not made pursuant to section 14, 15 or 16 for the purpose of issuing or extending a certificate, and

(c) the inspection is not an inspection referred to in section 17.1, 17.2 or 17.3.

Port State Control Inspection

17.1 A fee of $1,000 is payable for each second and subsequent visit that is made by an inspector, where an inspection is required for the purpose of lifting a detention order so that a non-Canadian ship can proceed on a voyage from any place in Canada.

17.2 A fee of $400 is payable for a second and each subsequent visit made by an inspector, where an inspection is required for the purpose of verifying that a defect that was identified during a Canadian Port State Control Inspection and that did not warrant the issuance of a detention order has been rectified, so that a non-Canadian ship can proceed on a voyage from any place in Canada.

17.3 A fee of $400 is payable for each visit that is made by an inspector where an inspection is required for the purpose of verifying that a defect identified in a Port State Control Inspection Report has been rectified in accordance with the time provisions set out in the Report.

PART IV

MISCELLANEOUS INSPECTIONS,
TESTS AND CERTIFICATES

Approval of Manufacturing or Servicing Plants

18. A fee of $403 is payable for an inspection, made pursuant to the Marine Machinery Regulations, of a plant for which approval is required for the manufacture or servicing of ships' machinery or equipment.

Inspections During Construction or Manufacture

19. (1) Subject to subsection (2), the fee payable for inspection during construction or manufacture of components for use on a ship that are set out in column I of an item of the table to this section is the fee set out in column II of that item

(2) A minimum fee of $100 is payable for each visit made by an inspector for an inspection referred to in subsection (1).

Tests of Materials

20. The fee payable for the inspection or testing of materials used in the construction of hulls, machinery, equipment or cargo gear is

(a) for each visit made by an inspector for the purposes of inspection and testing $100

(b) where more than three tests are made at one visit, each additional test $25

Inspection of Imported Machinery and Equipment

21. The fee payable for inspection during installation of machinery or equipment that was not previously inspected, that was built outside Canada and that is required to be inspected pursuant to the Marine Machinery Regulations is, for machinery or equipment set out in column I of an item of the table to this section, the fee set out in column II of that item.

Issuance of Certificate of Approval

21.1 The fee payable for the initial issuance of a certificate of approval for structural or outfitting components or for safety equipment is $400, and the fee payable for each renewal of the certificate of approval is $200.

PART V

Examination or Approval of Plans and Other Documents

22. (1) Subject to subsections (2) and 22.1(2) and section 22.2, the fee payable for the examination or approval of a first submission of each plan, each diagrammatic layout, each system schematic or each technical document submitted in respect of a new ship or modifications to an existing ship of a class set out in column I of an item of the table to this section is the fee set out in column II of the item, and the maximum fee payable in respect of the ship is the fee set out in column III of that item.

(2) The fee set out in subsection (1) is not payable in respect of an identical sister ship whose keel is laid, or is at a similar stage of construction, within 18 months of the keel laying of the original ship.

(3) The fee payable for the examination or approval of a second and each subsequent submission of each plan, each diagrammatic layout, each system schematic or each technical document submitted in respect of a new ship or modifications to an existing ship of a class set out in column I of an item of the table to this section is one half of the fee set out in column II of the item, with no maximum fee.

(4) Where a non-passenger ship or fishing vessel is designed to carry passengers, it shall be considered to be a passenger vessel for the purposes of this section.

22.1 (1) The fee payable for the examination or approval of a first submission of the plans and related technical documents for a component set out in column I of an item of the table to this section for use on a ship is the fee set out in column II of the item.

(2) The fee payable for the examination or approval of a second and each subsequent submission of the plans and related technical documents for a component set out in column I of an item of the table to this section for use on a ship is one half of the fee set out in column II of the item.

22.2 Where more than four copies of a plan, diagrammatic layout, system schematic or technical document are submitted for examination or approval, the fee payable for each additional copy, in respect of a ship of a class set out in column I of an item of the table to section 22 or a component set out in column I of an item of the table to section 22.1 for use on a ship, is one quarter of the fee set out in column II of the item, with no maximum fee.

PART VI

LOAD LINE SURVEYS

Issue and Renewal of Load Line Certificates and
Annual Load Line Surveys

23.  In this Part,

"classed ship" means a ship that is classed with a classification society approved by the Minister;

"unclassed ship" means a ship other than a classed ship.

24. Subject to section 25,

(a) the fee for a Load Line survey made prior to issuing a Load Line Certificate for a classed ship having a gross tonnage referred to in an item set out in Column I of the table to this section is the amount set out for that item in Column II of the table;

(b) the fee for annual Load Line survey of a classed ship having a gross tonnage referred to in an item set out in Column I of the table to this section or for a Load Line survey made prior to renewing a Load Line Certificate for such a ship, is the amount set out for that item in Column III of the table;

(c) the fee for a Load Line survey made prior to issuing or renewing a Load Line Certificate for an unclassed ship having a gross tonnage referred to in an item set out in Column I of the table to this section is the amount set out for that item in Column IV of the table; and

(d) the fee for an annual Load Line survey of an unclassed ship having a gross tonnage referred to in an item set out in Column I of the table to this section is the amount set out for that item in Column V of the table.

25. (1) For each annual Load Line survey of a ship, a fee of $100 is payable for a second and each subsequent visit by an inspector for the purposes of the survey.

(4) Where minor alterations have been made to a ship, having a Load Line Certificate in force, that involve an alteration of the freeboard but do not require a full Load Line survey, the fee for a classed or unclassed ship is an amount equal to the amount of the fee required for that ship in Column III of the table to section 24.

(5) Where for special reasons a partial Load Line survey is made and a Load Line Certificate is issued or renewed for a eriod not exceeding 12 months, the fee is an amount equal to one-half the amount of the fee specified in column II, III or IV of the table to section 24, as the case may be.

Extension of Load Line Convention
Certificates for Non-Canadian Ships

26. A fee of $1,000 is payable for an inspection of a non-Canadian ship for the purpose of extending a Load Line Convention Certificate.

Authorization for Clearance

27. A fee of $1,000 is payable for each visit made by an inspector where

(a) an inspection is required for the purpose of obtaining authorization for clearance for a non-Canadian ship to proceed on a voyage from any place in Canada;

(b) the inspection is not made pursuant to section 24, 25 or 26 for the purpose of issuing, renewing or extending a Load Line Certificate, and

(c) the inspection is not made pursuant to section 17.1, 17.2 or 17.3.

PART VII

Out-of-Hours Duties

28. The fee payable for each visit for the purpose of a survey or inspection of a ship by an inspector, or a service performed by an inspector, at the request of a shipyard operator, shipowner or ship operator, or authorized representative thereof, including the travelling time related to the visit, that is conducted during the hours set out in column I of an item of the table to this section is, in addition to any other fee payable, the greater of the fees set out in columns II and III of the item.

Standby Fee for Inspectors

29. Where a shipyard operator, shipowner or ship operator, or an authorized representative thereof, requests that an inspector be on call or be made available, either continuously or during specified periods, to survey or inspect a ship or to perform a service, a standby fee of $500 is payable, in addition to all other fees payable, for each calendar day or portion thereof that the inspector is on call or made available.

Other Examinations or Inspections

30. The fee payable for a service set out in column I of an item of the table to this section is the fee set out in column II of the item.

Oil Pollution Prevention

31. (1) In addition to any other fees payable, the fee payable for the inspection of a ship, other than an oil tanker or a barge that carries oil in bulk, leading to the issuance of an International Oil Pollution Prevention Certificate, a Canadian Oil Pollution Prevention Certificate or a Certificate of Compliance (Oil), for a ship of the gross tonnage set out in column I of an item of the table to this subsection, is the applicable fee set out in column II, III or IV of the item.

(2) In addition to any other fees payable, the fee payable for the inspection of an oil tanker or a barge that carries oil in bulk under Annex I of the Pollution Convention, leading to the issuance of an International Oil Pollution Prevention Certificate, a Canadian Oil Pollution Prevention Certificate or a Certificate of Compliance (Oil), for a ship having the gross tonnage set out in column I of an item of the table to this subsection, is the applicable fee set out in column II, III or IV of the item.

Examination of Plans and Technical Documents

32. (1) The fee payable for the examination of a first submission of a plan or technical document for any class of ship, which plan or document is set out in column I of an item of the table to this section, is the fee set out in column II of the item.

(2) The fee payable for the examination of a second and each subsequent submission of a plan or technical document set out in column I of an item of the table to this section, is one half of the fee set out in column II of the item.

(3) Where an existing ship is modified and the modifications constitute a major conversion as defined in Annex I, chapter I, Regulation 1(8), of the Pollution Convention, the fee payable for the first or a subsequent submission of a plan or technical document is the fee referred to in subsection (1) or (2), as applicable.

(4) Where more than four copies of a plan or technical document set out in column I of an item of the table to this section are submitted for examination, the fee payable for each additional copy is one quarter of the fee set out in column II of the item.

Inspection of Pollution Prevention Equipment

33. (1) The fee payable for an inspection during the construction or manufacture of components of a piece of a ship's operational pollution prevention equipment is $100.

(2) The fee payable for the issuance of a Certificate of Approval of a ship's operational pollution prevention equipment, when inspected, tested and approved by an inspector in accordance with an International Maritime Organization (IMO) Standard, is $300.

(3) The fee payable for the issuance of a Certificate of Approval of a ship's operational pollution prevention equipment that meets the requirements of the Oil Pollution Prevention Regulations and the Dangerous Chemicals and Noxious Liquid Substances Regulations, when approved by another Administration that is a signatory to the Pollution Convention, is $400.

Dangerous Chemical and Noxious Liquid Substance

34. (1) In addition to any other fees payable, the fee payable for an inspection leading to the issuance of an International Pollution Prevention Certificate for the Carriage of Noxious Liquid Substances in Bulk, a Canadian Pollution Prevention Certificate for the Carriage of Noxious Liquid Substances in Bulk, an International Certificate of Fitness for the Carriage of Dangerous Chemicals in Bulk, a Certificate of Fitness for the Carriage of Dangerous Chemicals in Bulk or a Certificate of Compliance (Noxious Liquid Substances), for a ship having the gross tonnage set out in column I of an item of the table to this section, is the applicable fee set out in column II, III or IV of the item.

(2) In addition to any other fee payable, a fee of $10 is payable for the inspection of a ship in respect of each dangerous chemical or noxious liquid substance specified in Annex II to the Pollution Convention and Chapter 17 of the International Code for the Construction and Equipment of Ships Carrying Dangerous Chemicals in Bulk (IBC Code) and listed for carriage in the Procedures and Arrangement Manual of the ship.

Great Lakes Sewage Pollution Prevention

Inspection of Marine Sanitation Devices

35. (1) The fee payable for an inspection during the construction or manufacture of components of each piece of a ship's operational marine sanitation device is $100.

(2) The fee payable for the issuance of a Certificate of Approval of a ship’s operational marine sanitation device, when inspected, tested and approved by an inspector in accordance with the Great Lakes Sewage Pollution Prevention Regulations, is $300.

(3) The fee payable for the issuance of a Certificate of Approval of a ship’s operational marine sanitation device that meets the requirements of the Great Lakes Sewage Pollution Prevention Regulations, when approved by another Administration, is $400.
