TO ALL TO WHOM these Presents shall come or whom the same may in anywise concern,--Greeting:

A PROCLAMATION

WHEREAS in and by section 22 of the Navigable Waters Protection Act, chapter 193 of the Revised Statutes of Canada, 1952, it is provided that Our Governor in Council may, from time to time, by proclamation, declare any navigable rivers, streams or waters, or part or parts thereof, exempted, in whole or in part, from the operation of those sections of the said Act that prohibit the deposit of rubbish or other material in navigable waters.

AND WHEREAS an application has been made by British Columbia Hydro and Power Authority for exemption from the operation of section 20 of the said Act in respect of part of the Columbia River in the Kootenay District, in the Province of British Columbia, described as follows:

ALL AND SINGULAR that certain piece, parcel or tract of land and premises, situate, lying and being in the Province of British Columbia and known as part of Lot Four Thousand, Five Hundred and Ninety-nine (4599), and part of Lot Three Thousand, Two Hundred and Sixty (3260) Kootenay District and part of the bed of the Columbia River and consisting of Four (4) parcels which may be more particularly described as follows:--

Parcel A - Commencing at a point on the West boundary of Lot One Hundred and Seven (107) of Lot Three Thousand, Two Hundred and Sixty (3260), Kootenay District, Plan 1678, Two Hundred and Thirty (230) feet South of the North-west corner of the said Lot One Hundred and Seven (107); Thence N 50_00'E Four Hundred and Sixty (460) feet; Thence N 84_40'E Three Hundred (300) feet; Thence S 71_35'E Four Hundred (400) feet; Thence S 81_40'E Two Hundred and Fifty (250) feet; Thence S 62_15'E Three Hundred and Eighty (380) feet; Thence S 28_35'E One Hundred and Forty (140) feet; Thence S 69_00'W Three Hundred and Sixty-five (365) feet; Thence N 86_50'W One Thousand, One Hundred and Fifty (1150) feet; Thence N 10_50'W One Hundred and Fifty (150) feet; Thence N 70_15'W One Hundred and Seventy-five (175) feet more or less to the point of commencement.

The hereinbefore described parcels are shown outlined in red on the Plan No. 209-S7-E19.R.1. on record in the Department of Transport.

AND WHEREAS it is expedient and Our Governor in Council has advised that the proclamation do issue declaring that the area described above be exempt from the operation of section 20 of the said Act.

NOW KNOW YE that We, by and with the advice of Our Privy Council for Canada, do by this Our Proclamation declare the area described above exempt from the operation of section 20 of the Navigable Waters Protection Act as aforesaid.

OF ALL WHICH Our Loving Subjects and all others whom these Presents may concern are hereby required to take notice and to govern themselves accordingly.

IN TESTIMONY WHEREOF, We have caused these Our Letters to be made Patent and the Great Seal of Canada to be hereunto affixed. WITNESS: Our Right Trusty and Well-beloved Counsellor, General GEORGES P. VANIER, a member of Our Most Honourable Privy Council, Companion of Our Distinguished Service Order upon whom We have conferred Our Military Cross and Our Canadian Forces' Decoration, Governor General and Commander-in-Chief of Canada.

AT OUR GOVERNMENT HOUSE, in Our City of Ottawa, this eighteenth day of March in the year of Our Lord one thousand nine hundred and sixty-five and in the fourteenth year of Our Reign.
