Notice with respect to a Critical Use of Methyl Bromide

Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer will decide, at their annual meeting, which uses of methyl bromide are granted a "critical" use exemption.

This exemption is with respect to the regulatory provisions that set the January 1, 2005 phase-out date for the production and importation of methyl bromide. If the critical use nomination is successful, an exemption will be granted by the Parties to the Protocol. This exemption will allow the production or importation of new methyl bromide after the phase-out date.

The following notice describes the criteria, process and schedule that will be use to determine the relevance of nominations for a "critical" use exemption. The use of methyl bromide present in Canada before the phase-out date or the use of recycled or reclaimed methyl bromide does not require an application for exemption.

Users of methyl bromide are hereby invited to submit, their nominations for "critical" use exemptions for the year 2005, prior to July 31, 2003, as described in this notice.

Note: Nominations for a critical use exemption for subsequent years are subject to the timeline as posted in the notice.
