Regulatory Issues


The following information is related to the Treasury Board Secretariat’s responsibilities toward regulatory issues.  To obtain more information on the Government of Canada Regulatory Policy and regulatory matters in general, you should contact the Privy Council Office, Regulatory Affairs & Orders in Council Secretariat

In July 1999, responsibility for the Government of Canada Regulatory Policy, its development and implementation shifted from Treasury Board (TB) to the Special Committee of Council (SCC). This transfer recognized the role of SCC in the law-making process and its accountability for the policies and processes governing development of both legislation and regulation. Consequently, the supporting role of the Treasury Board Secretariat and the Privy Council Office in the regulatory process have been adjusted to reflect the transfer.

The Regulatory Issues Unit of the Treasury Board of Canada Secretariat (TBS) is responsible for the following:

  • support to the President of the Treasury Board (TB)on regulatory issues, especially in her capacity as a member of the SCC;
  • support the Treasury Board when it acts as the Committee of the Privy Council for mostly non-regulatory matters to give approval to submissions to the Governor in Council without having to forward these to the Special Committee of Council;
  • support to TBS senior management on regulatory issues, including the Deputy Ministers' Challenge Team on Law-making and Governance;
  • advice and guidance to TBS employees on regulatory issues;
  • participation in various interdepartmental committees on governance and regulatory issues and in various initiatives related to the Regulatory Policy Review.

These roles are guided by existing policy frameworks, as well as statutory requirements. For example, the federal government Cost Recovery and Charging Policy, for which TBS is responsible, provides an important policy framework for regulations dealing with fees and cost recovery.
