1. THIS MSG ADDRESSES THE POLICY REGARDING R AND Q AT PUBLIC EXPENSE FOR RESERVISTS ON CLASS B RESERVE SVC. REFS A/B WERE WRITTEN AT A TIME WHEN A SIGNIFICANT PAY DIFFERENTIAL EXISTED BETWEEN REG AND RES FORCE PERSONNEL. MANY INITIATIVES HAVE SINCE OCCURRED TOADDRESS THOSE DIFFERENCES. THE PURPOSE OF THIS MSG IS TO REVISE AND CLARIFY CURRENT POLICY, AND AMPLIFY PARA 13 OF REF C AND PARA 4 OF REF D. REFS A AND B ARE SUPERCEDED BY THIS AUTHORITY, EFFECTIVE 01 SEP 01

2. R AND Q AT PUBLIC EXP WILL BE PROVIDED TO RESERVISTS UP TO A MAXIMUM OF 364 DAYS WHO MEET CERTAIN CONDITIONS OF PRIMARY RESIDENCE, LOCATION OF EMPLOYING UNIT (EU), AND LENGTH OF PERIOD OF EMPLOYMENT (PD OF EMP). THE ORDER OF PRIORITY WITH RESPECT TO ALLOC OF SINGLE QUARTERS (SQ) IS DETERMINED BY PARA 5C OF REF C

3. PRIMARY RESIDENCE. RATIONALE FOR THE PROVISION OF QTRS AT PUBLIC EXP IS BASED ON THE PRINCIPLE THAT A MBR IS EXPECTED TO MAINTAIN FIN RESPONSIBILITY FOR ONE PRIMARY RESIDENCE. TO THIS END, RESERVISTS MAY BE ENTITLED TO QTRS AT PUBLIC EXP AT THE SUPPORTING BASE CLOSEST TO THE EU FOR THE DURATION OF

THEIR PD OF EMP PROVIDED THAT THE MBR:

A. MAINTAINS FIN RESPONSIBILITY FOR A PRIMARY RESIDENCE AT THEIR PLACE OF ORDINARY RESIDENCE (POR) WHICH WILL REMAIN UNOCCUPIED DURING THE ABSENCE AND IS NOT SHARED, RENTED OR SUBLET; AND

B. PERSONAL HG AND E REMAINS AT THE PRIMARY RESIDENCE (NOT IN STORAGE)

4. LOCATION OF EU. TO BE ENTITLED TO R AND Q AT PUBLIC EXP, RESERVISTS MUST BE EMPLOYED ON CLASS B RESERVE SVC OUTSIDE OF THE GEOGRAPHICAL AREA OF THEIR PARENT UNIT AND PLACE OF RESIDENCE (POR). MBRS EMPLOYED ON CLASS B RESERVE SVC WITHIN THE GEOGRAPHICAL AREA OF THEIR PARENT UNIT MAY BE GRANTED R AND Q AT PUBLIC EXP ONLY WITH THE APPROVAL OF THE BASE/WING/ASU COMMANDER FOR THE SPECIFIED PERIOD WHERE JUSTIFIED BY SVC REASONS. INCIDENTALS SHALL NOT BE PAID TO MBRS WHO RECEIVE R AND Q AT UNCLASSIFIED

5. LENGTH OF A SINGLE PD OF EMP. THE LIMIT FOR TD BENEFITS IS 180 DAYS AND FOR ATTACHED POSTING-LIKE BENEFITS IS 364 DAYS. THE RATIONALE FOR THE LIMIT TO WHICH R AND Q AT PUBLIC EXP MAY BE OFFERED IS THAT AT SOME POINT, THE EMPLOYER AND MBR MUST DECIDE IF EMPLOYMENT AT THE EU WILL BE SHORT OR LONG TERM. A RES MBR WHO ACCEPTS A CONTINUOUS PD OF EMP OF:

A. 180 DAYS OR LESS: WHERE CONDITION OF LOCATION OF EU IS MET, MBR IS ENTITLED TO TD BENEFITS INCLUDING R AND Q AND INCIDENTALS AT PUBLIC EXP IAW REF G

B. BETWEEN 181 AND 364 DAYS WHERE MBR IS SINGLE AND CONDITIONS OF PRIMARY RESIDENCY AND LOCATION OF EU ARE MET: ENTITLED TO ATT POSTING-LIKE BENEFITS. THAT IS, ENTITLEMENT TO SQ ONLY AT PUBLIC EXP, AND CUSTODIAL EXP FOR THE VACANT RESIDENCE IF APPLICABLE, BUT A SINGLE MBR MUST PAY FOR RATIONS IAW REF E AND REF H

D. 365 DAYS AND OVER: MBR MAY BE ENTITLED TO RELOCATION BENEFITS UNCLASSIFIED

UNDER TR POL 009/95. APPROVAL UNDER MINISTERIAL AUTH MUST BE OBTAINED FROM NDHQ/DCBA THROUGH THE CHAIN OF COMD. THEREFORE FOR PERIODS OF EMP OF ONE YR AND OVER, UNLESS IMPOSED RESTRICTION (IR) IS AUTH UNDER REF E, MBRS ARE NOT ENTITLED TO R AND Q AT PUBLIC EXP

6. LENGTH OF CONSECUTIVE PERIODS OF EMP. WHERE CONDITIONS OF RESIDENCY AND LOCATION OF EU ARE MET, A MBR WHO IS OFFERED A PD OF EMP OF LESS THAN 180 DAYS AND THE PD OF EMP IS SUBSEQUENTLY EXTENDED TO BRING THE TOTAL CONTINUOUS PERIOD OF CLASS B RESERVE SVC OVER 180 DAYS, THE MBR’S BENEFITS CONVERT TO ATT POSTING-LIKE BENEFITS THE DAY AFTER THE EXTENSION IS GRANTED. I.E., IF THE MBR ACCEPTS A PD OF EMP FOR 175 DAYS, AND ON THE 140TH DAY THE MBR’S PD OF EMP IS EXTENDED FOR AN ADDITIONAL 180 DAYS, THE MBR'S ENTITLEMENTS WOULD CONVERT FROM TD TO ATT POSTING-LIKE BENEFITS ON DAY 141. SIMILARLY, IF A SHORTER CONTRACT IS EXTENDED OVER 364 DAYS, THEN PARA 5 D. ABOVE WILL APPLY.

7. FUNDING. THE EMPLOYER OR HIRING AUTHORITY IS RESP FOR COSTS ASSOCIATED WITH BENEFITS RECEIVED UNDER THE AUTH OF THIS MSG, THAT IS, FOR PERIODS OF EMP UP TO 364 DAYS. WHEN CONTRACTS ARE 365 DAYS OR LONGER, COSTS WILL BE CENTRALLY FUNDED BY NDHQ IAW TR POL 009/95 AND FIN CODE WILL BE PROVIDED UPON NDHQ/DCBA APPROVAL

8. BREAK IN SERVICE. IT IS INTENDED THAT EU'S BE PROVIDED WITH

CLARIFICATION WITH RESPECT TO HOW A BREAK IN SVC IS TO BE TAKEN INTO ACCOUNT FOR THE PROVISION OF R&Q AT PUBLIC EXP. IN THE

CASE OF AN INTENTIONAL SHORT BREAK IN SVC (SUCH AS THE ELECTED BREAK FOR ANNUITANTS OR OTHER SIMILAR SCENARIOS), THE BREAK SHALL NOT CREATE THE ARTIFICIAL CONDITION WHERE A MBR COULD "REQUALIFY" FOR AN ADDITIONAL YEAR OF R AND Q AT PUBLIC EXP. IN EFFECT: R&Q FOR RESERVISTS AT PUBLIC EXP CANNOT EXCEED A MAX OF 364 DAYS.

9. EMPLOYERS OF RESERVISTS MUST UNDERSTAND THE IMPLICATIONS OF OFFERING REPETITIVE PERIODS OF EMP OF SHORT DURATION AND MAKE RESPONSIBLE EMPLOYMENT DECISIONS. MOREOVER, EMPLOYERS MUST ENSURE THAT RESERVE MBRS ARE NOT UNFAIRLY ADVANTAGED OR DISADVANTAGED IN THE BENEFITS THEY MAY BECOME ELIGIBLE FOR AS A RESULT OF IMPROPER ADMIN OR HIRING PROCEDURES.
