The Refugee Appeal Division

The Immigration and Refugee Protection Act (IRPA), which became law on June 28, 2002, contains provisions for a Refugee Appeal Division (RAD). These provisions were never implemented. The Government’s position is that the current system is fully in accord with the Charter of Rights and Freedoms and international legal obligations, and remains fair and generous even without an appeal on merit.
