PART VIII - DECISION OR ORDER SOUGHT ON APPEAL

NOTE: Subsection 23(2) of the Act provides as follows:

"(2) An appeal board may dispose of an appeal by

(a) dismissing the appeal and confirming the decision or order of the screening officer; or

(b) allowing the appeal and either varying or rescinding the decision or order being appealed."

APPENDIX - FEE CALCULATION (Subsection 20(2) of the Act and section 12 of the Hazardous Materials Information Review Regulations)

NOTE: Appeal fees must be paid by certified cheque or money order in Canadian dollars to the Receiver General for Canada.

(b) an affected party who is a member, official or representative of a trade union that

  1. is a non-affiliated trade union, and

(c) a claimant that

  1. has a gross annual revenue of not more than three million dollars in the claimant's fiscal year immediately preceding the fiscal year in which the statement of appeal is filed; and
  1. does not employ more than 100 employees.
