Producer Car Order for Crop Year 2006-2007

Order No. 2006-47

August 1, 2006

Pursuant to sub-section 87 (b) of the Canada Grain Act, R.S.C. 1985 as amended, the Canadian Grain Commission (the Commission) orders that the allocation of producer railway cars be subject to the following terms and conditions:

  1. The number of producers who may load a single producer car is limited to five. One of the five shall be designated as the principal producer, and act as the administrator for documentation and communication;
  2. The Commission shall, in each week, allocate available railway cars, as determined by the railways, for carriage of grain to a terminal elevator, transfer elevator, process elevator, or to a consignee at a destination other than an elevator to:
    1. applications for railway cars for shipment of grain deliverable to the Canadian Wheat Board (CWB), in the order in which such applications are received, subject to grain and grade requirements as established by the CWB;
    2. applications for railway cars for the shipment of all other grain to all destinations, in the order in which such applications are received, provided that the applicant has demonstrated to the Commission’s satisfaction that the grain to be shipped is committed to a confirmed sale and that the railway cars are required to be allocated in that week in order to fulfill the commitment;
    3. where a sale has not been confirmed, applications for railway cars, in the order in which such applications are received, up to 10% of the railway cars available for the shipment of any one type of all other grain to a particular destination;
  3. In any shipping week, for which there are applications for more railway cars than are available for allocation under paragraph 2(c):
    1. no applicant(s) will be allocated more than two railway cars;
    2. no applicant(s) who has received a railway car for a particular type of grain in the crop year in question will be allocated any additional railway cars until all other applicants who applied to ship grain of the same type for the same period have been allocated a railway car;
  4. No producer shall load any grain to a railway car, allocated as set out above, containing visible excreta of deer, antelope, elk or moose.

This Order shall expire on July 31, 2007, unless previously revoked by the Commission.
