Acquisition of Permanent Resident Status Fee Remission Order

P.C. 2006-366 May 11, 2006

Her Excellency the Governor General in Council, considering that it is in the public interest to do so, on the recommendation of the Minister of Citizenship and Immigration and the Treasury Board, pursuant to subsection 23(2.1) (see footnote a) of the Financial Administration Act, hereby makes the annexed Acquisition of Permanent Resident Status Fee Remission Order.

  ACQUISITION OF PERMANENT RESIDENT STATUS FEE REMISSION ORDER
  REMISSION
Remission 1. Remission is hereby granted of the amount of $485, being a portion of the fee of $975 payable under subsection 303(1) of the Immigration and Refugee Protection Regulations, if
(a) the fee is paid at or after 12:00 a.m. Eastern Daylight Saving Time on May 3, 2006 and before the coming into force of the Regulations Amending the Immigration and Refugee Protection Regulations (Section 303 Fee); or
(b) the fee was paid before 12:00 a.m. Eastern Daylight Saving Time on May 3, 2006 and the person in respect of whom the fee was paid acquires permanent resident status at or after 12:00 a.m. Eastern Daylight Saving Time on May 3, 2006 and before the coming into force of the Regulations Amending the Immigration and Refugee Protection Regulations (Section 303 Fee).
Payment 2. In the case where the fee of $975 was paid, the amount remitted shall be repaid to the person who paid the fee.

EXPLANATORY NOTE

(This note is not part of the Order.)

Section 303 of the Immigration and Refugee Protection Regulations establishes the obligation to pay the fee of $975 for the acquisition of permanent resident status. That fee is payable either prior to acquiring permanent residence status, in the case of a person who applies to remain in Canada as a permanent resident, or prior to the issuance of a permanent resident visa, in the case of a person who applies from abroad.

The requirement changes as of May 3, 2006 following an announcement by the Government of Canada that, as of that date, there would be a reduction in the fee by approximately 50%, from $975 to $490. An amendment to the Immigration and Refugee Protection Regulations will effect this reduction. However, because that amendment does not come into force concurrently with the Government announcement, there is a period of several days when a remission order is required to render the reduction applicable as of the date and time set out in that announcement.

This Order remits the amount of $485, representing the difference between the original fee in the amount of $975 and the new fee in the amount of $490, to the following persons:

(a) any person who pays the fee during the period beginning on May 3, 2006 and ending on the coming into force of the amendment to the Immigration and Refugee Protection Regulations; and

(b) any person who paid the fee in the amount of $975 before May 3, 2006 and who is granted permanent resident status during the period beginning on that date and ending on the coming into force of the amendment to the Immigration and Refugee Protection Regulations.

Over the life of this Order, the estimated amount to be remitted will be $970,000. This includes cash payments for affected persons who will have obtained permanent resident status during the period beginning on May 3, 2006 and ending on the coming into force of the amendment to the Immigration and Refugee Protection Regulations on or about May 12, 2006. This initiative is funded through the Federal Budget.
