Quebec Turkey Marketing Levies Order

ORDER PROVIDING FOR THE FIXING, IMPOSING AND COLLECTING OF LEVIES FROM CERTAIN TURKEY PRODUCERS IN QUEBEC

SHORT TITLE

1. This Order may be cited as the Quebec Turkey Marketing Levies Order.

INTERPRETATION

2. In this Order,

"Act" means the Farm Products Marketing Act of Quebec; (Loi)

"Commodity Board" means the Fédération des producteurs de volailles du Québec, established pursuant to the Act; (Office de commercialisation)

"market allotment" means the total quantity of turkey meat that a producer is entitled to market in intraprovincial, interprovincial and export trade pursuant to the Canadian Turkey Marketing Quota Regulations and the regulations enacted by the Commodity Board pursuant to the Plan; (allocation de commercialisation)

"Plan" means the Quebec Poultry Producers' Joint Plan established and amended from time to time pursuant to the Act and any regulations made thereunder to give effect to the Plan; (Plan)

"producer" means any person engaged in the production or growing of turkeys in the Province of Quebec and subject to the Plan; (producteur)

"turkey" means a turkey produced or grown in the Province of Quebec for the purpose of slaughter. (dindon)

LEVIES

3. In addition to the charges set out under the Plan, levies are payable to the Commodity Board by every producer at the rate of $0.05 per pound, live weight, on every turkey marketed by him that is in excess of his market allotment.

METHOD OF PAYMENT

4. (1) Every person who buys turkeys from a producer shall deduct from the moneys payable to the producer for the turkeys all levies payable by the producer to the Commodity Board under section 3 and shall pay such levies to the Commodity Board at its office, 515 Viger Street East, Montreal, Quebec, not later than the 15th day of the month next following the month in which the levies were deducted.

(2) Every producer shall pay to the Commodity Board at its office, 515 Viger Street East, Montreal, Quebec, all levies payable by him under section 3 that were not deducted and paid to the Commodity Board in the manner prescribed in subsection (1), not later than the 15th day of the month next following the month in which the turkeys in respect of which the levies are payable were sold.
