Lower St. Lawrence Region Wood Producers' Levy (Interprovincial and Export Trade) Order

ORDER RESPECTING THE FIXING AND IMPOSING OF LEVIES ON AND THE COLLECTING OF LEVIES FROM PRODUCERS OF WOOD IN THE LOWER ST. LAWRENCE AREA IN THE PROVINCE OF QUEBEC FOR WOOD MARKETED IN INTERPROVINCIAL AND EXPORT TRADE

SHORT TITLE

1. This Order may be cited as the Lower St. Lawrence Region Wood Producers' Levy (Interprovincial and Export Trade) Order.

INTERPRETATION

2. In this Order,

"producer" means a person engaged in the production of wood; (producteur)

"Syndicate" means the Lower St. Lawrence Wood Producers' Syndicate; (Syndicat)

"wood" means wood produced in the Province of Quebec in the municipal counties of

(a) Bonaventure in the municipalities of

(i) L'Ascension-de-Patapédia,

(ii) St-Alexis-de-Matapédia,

(iii) St-André-de-Restigouche,

(iv) St-François-d'Assise, and

(v) St-Laurent-de-Matapédia,

(b) Matane,

(c) Matapédia,

(d) Rimouski,

(e) Rivière-du-Loup except the municipalities of

(i) Notre-Dame-du-Portage,

(ii) St-Antonin, and

(iii) St-Patrice-de-la-Rivière-du-Loup, and

(f) Témiscouata. (bois)

LEVIES

3. (1) A producer shall pay to the Syndicate for wood produced by him and marketed in interprovincial and export trade a general administration levy calculated at one of the following rates:

(a) where the wood marketed is measured in cords of 128 apparent cubic feet, $0.75 per cord;

(b) where the wood marketed is measured in cubic feet, $0.88 per 100 cubic feet;

(c) where the wood marketed is measured in foot-board measures, $1.76 per 1,000 foot-board measure;

(d) where the wood marketed is measured in cubic-foot tree lengths, $0.0088 per cubic-foot tree length;

(e) where the wood marketed is measured in apparent cubic metres, $0.21 per apparent cubic metre; and

(f) where the wood marketed is measured in solid cubic feet, $0.32 per solid cubic foot.

(2) In addition to the levy imposed by subsection (1), a producer shall pay to the Syndicate for wood produced by him and marketed in interprovincial and export trade the following research levy:

(a) in the case of wood from coniferous trees, $0.04 per apparent cubic metre; and

(b) in the case of wood from deciduous trees, $0.02 per apparent cubic metre.

(3) In addition to the levies imposed by subsections (1) and (2), a producer shall pay to the Syndicate for wood produced by him and marketed in interprovincial and export trade for production into pulp, paper or chipboard the following working fund levy:

(a) in the case of pulpwood from coniferous trees and debarked pulpwood from deciduous trees, $0.62 per apparent cubic metre; and

(b) in the case of undebarked pulpwood from deciduous trees, $0.41 per apparent cubic metre.

METHOD OF COLLECTION

4. (1) Subject to subsections (2) and (3), a producer shall pay any levy payable by him pursuant to section 3 to the Syndicate at its headquarters in Rimouski, Quebec, within 30 days after the marketing of the wood in respect of which the levy is payable.

(2) Where the Syndicate markets wood in interprovincial or export trade on behalf of a producer, the Syndicate may deduct from any money payable to the producer by the Syndicate any levy payable by the producer, pursuant to section 3, in respect of that wood.

(3) Where a producer does not pay the levy set out in section 3 directly to the Syndicate pursuant to subsection (1) and where the Syndicate has not deducted the levy pursuant to subsection (2), any person who markets that producer's wood in interprovincial or export trade shall

(a) deduct from any money payable to the producer by that person any levy payable by the producer to the Syndicate pursuant to section 3; and

(b) pay over and account to the Syndicate for the levy within 30 days after the marketing of the wood in respect of which the levy is payable.
