British Columbia Tree Fruit Order

ORDER GRANTING AUTHORITY TO REGULATE THE MARKETING OF TREE FRUIT IN BRITISH COLUMBIA

SHORT TITLE

1. This Order may be cited as the British Columbia Tree Fruit Order.

INTERPRETATION

2. In this Order,

"Act" means the Natural Products Marketing (British Columbia) Act; (Loi)

"Commodity Board" means the British Columbia Tree Fruit Marketing Board established pursuant to the Act; (Office)

"Plan" means the British Columbia Tree Fruit Marketing Scheme established and amended from time to time pursuant to the Act and any regulations made pursuant to the Act to give effect to the Plan; (Plan)

"tree fruit" means tree fruit grown and produced in the Province of British Columbia. (fruit de verger) SOR/80-262, s. 1.

INTERPROVINCIAL AND EXPORT TRADE

3. The Commodity Board is authorized to regulate the marketing of tree fruit in interprovincial and export trade and for such purposes may, with respect to persons and property situated within the Province of British Columbia, exercise all or any powers like the power exercisable by it in relation to the marketing of tree fruit locally within that province under the Act and the Plan. SOR/85-1106, s. 1.

LEVIES

4. The Commodity Board may, in relation to the powers granted to it by section 3 with respect to the marketing of tree fruit in interprovincial and export trade,

(a) fix and impose by order and collect levies or charges from persons situated in the Province of British Columbia who are engaged in the production or marketing of tree fruit and for that purpose classify those persons into groups and, by order, fix the levies or charges payable by the members of the different groups in different amounts; and

(b) use the levies or charges for the purposes of the Commodity Board, including the creation of reserves, and the payment of expenses and losses resulting from the sale or disposal of tree fruit, and the equalization or adjustment among producers of tree fruit of moneys realized from the sale of tree fruit during such period or periods of time as the Commodity Board may determine.
