Manitoba Turkey Order

ORDER GRANTING AUTHORITY TO REGULATE THE MARKETING IN INTERPROVINCIAL AND EXPORT TRADE OF TURKEYS PRODUCED IN MANITOBA

SHORT TITLE

1. This Order may be cited as the Manitoba Turkey Order.

INTERPRETATION

2. In this Order,

"Act" means The Natural Products Marketing Act of Manitoba; (Loi)

"Board" [Revoked, SOR/82-669, s. 1]

"Commodity Board" means the Manitoba Turkey Producers' Marketing Board established pursuant to the Act; (Office de commercialisation)

"Plan" means any plan for the marketing of turkeys, established and amended from time to time pursuant to the Act; (Plan)

"turkey" means a turkey of any variety, grade or class raised or kept for slaughter within the Province of Manitoba. (dindon) SOR/82-669, s. 1.

INTERPROVINCIAL AND EXPORT TRADE

3. The Commodity Board is authorized to regulate the marketing of turkeys in interprovincial and export trade and for such purposes may, by order, with respect to persons and property situated within the Province of Manitoba, exercise all or any powers like the powers exercisable by it in relation to the marketing of turkeys locally within that Province under the Act and Plan, other than those powers that are exercised by the Canadian Turkey Marketing Agency pursuant to the Farm Products Marketing Agencies Act. SOR/82-669, s. 2.

LEVIES

4. The Commodity Board is authorized,

(a) [Revoked, SOR/80-90]

(b) in relation to the powers granted to it by section 3 with respect to the marketing of turkeys in interprovincial and export trade,

to make orders, fixing, imposing and collecting levies or charges from persons situated within the Province of Manitoba who are engaged in the production or marketing of turkeys and for such purpose classifying such persons into groups and fixing the levies or charges payable by the members of different groups in different amounts and the Commodity Board may use such levies or charges for its purposes, including the creation of reserves and the payment of expenses and losses resulting from the sale or disposal of turkeys and the equalization or adjustment among the producers of turkeys of moneys realized from the sale thereof during such period or periods of time as it may determine.
