Saskatchewan Flax Order

Her Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture and Agri-Food, pursuant to section 2a of the Agricultural Products Marketing Act, hereby makes the annexed Saskatchewan Flax Order.

SASKATCHEWAN FLAX ORDER

INTERPRETATION

1. The definitions in this section apply in this Order.

"Act" means The Agri-Food Act, Statutes of Saskatchewan, S.S. 1990-91, c. A-15.2. (Loi)

"Commission" means the Saskatchewan Flax Development Commission established pursuant to the Act. (Commission)

"flax" means the seeds, straw, fibre, shives, or any part of the plant linum usitatissimum. (lin)

"Plan" means The Saskatchewan Flax Development Plan, established pursuant to section 3 of The Saskatchewan Flax Development Plan Regulations, R.R.S. c. A-15.2 Reg 5, as amended from time to time, made pursuant to the Act. (plan)

INTERPROVINCIAL AND EXPORT TRADE

2. The Commission is authorized to regulate the marketing of flax in interprovincial and export trade and for those purposes may, with respect to persons and property situated in Saskatchewan, exercise all or any powers like the powers exercisable by the Commission under the Act and the Plan in relation to the marketing of flax locally, within Saskatchewan.

LEVIES OR CHARGES

3. The Commission may, in relation to the powers granted to it by section 2,

(a) fix, impose and collect levies or charges from persons referred to in that section who are engaged in the production or marketing of flax and for those purposes may classify those persons into groups and fix the levies or charges payable by the members of the different groups in different amounts; and

(b) use the levies or charges for the purposes of the Commission, including the creation of reserves.

COMING INTO FORCE

4. This Order comes into force on the day on which it is registered.
