FEDERAL COURT OF CANADA JUDICIAL APPOINTMENTS



OTTAWA, November 5, 1999 -- The Honourable Anne McLellan, Minister of Justice and Attorney General of Canada, today announced the following appointments:

The Honourable Madam Justice Karen R. Sharlow, a Judge of the Federal Court of Canada-Trial Division is appointed a Judge of the Federal Court of Canada-Appeal Division. She replaces Mr. Justice Barry L. Strayer who has chosen to become a supernumerary judge.

Madam Justice Sharlow received her LL.B. from the University of British Columbia in 1981, and was called to the Bar of British Columbia in 1982. Prior to her appointment to the Federal Court of Canada-Trial Division, Madam Justice Sharlow specialized in tax litigation with the firm of Thorsteinssons in Vancouver. Madam Justice Sharlow served as a member of the Tax Court of Canada's Bench and Bar Committee and of the Federal Court of Canada's Rules Committee.

J. Brian D. Malone, Q.C., of Calgary is appointed a Judge of the Federal Court of Canada-Appeal Division. He replaces Mr. Justice F.J. McDonald who has chosen to become a supernumerary judge.

Mr. Justice Malone received his LL.B. from the University of New Brunswick in 1969, and was called to the New Brunswick Bar in the same year. In 1979, he became a member of the Alberta Bar. Prior to his appointment, Mr. Justice Malone practised law with the firm of McCarthy, Tétrault in Calgary where, since 1990, he served as managing partner and from 1995 to 1997, as National Chairman. He was appointed Queen's Counsel in 1987. Throughout his career, Mr. Justice Malone has made presentations and written extensively on subjects pertaining to his broad litigation experience.

These appointments are effective immediately.

Elizabeth Heneghan, Q.C., of St. John's is appointed a Judge of the Federal Court of Canada-Trial Division. She replaces Madam Justice Karen Sharlow who was appointed to the Federal Court of Canada-Appeal Division.

Madam Justice Heneghan received her LL.B. from Dalhousie University in 1980, and was called to the Bar that same year. Madam Justice Heneghan began the practice of law with the firm Lewis & Sinnott in St. John's, later known as Lewis, Sinnott & Heneghan. In 1995, she became a sole practitioner specializing in admiralty law and civil litigation. Prior to her appointment, Madam Justice Heneghan served as a Bencher of the Law Society of Newfoundland and was a member of the Statutory Rules Committee of the Federal Court of Canada. Madam Justice Heneghan has been a panelist and lecturer at numerous professional conferences.

This appointment takes effect on November 15, 1999.
