![]() Statement by the Chairperson of the IRB Regarding Allegations of a Serious Breach of the Members' Code of ConductOttawa, October 2, 2006 On September 27, 2006, I became aware of allegations of a serious breach of the Members' Code of Conduct in relation to a particular case before the Refugee Protection Division of the IRB in Toronto. As Chairperson of the Board, it is my responsibility to ensure that allegations of impropriety are quickly and properly investigated, and that all appropriate actions are taken. The allegations of misconduct in this instance are very serious and there has been an immediate response from my office. On September 28, I conducted a preliminary review of the matter. I took the decision to remove the Member from hearing cases pending further internal review of the matter. In addition, and as a precautionary measure, I took the decision to withdraw the Member's access to IRB premises. At the same time, the necessary actions are being taken to ensure that the claimant in this case will not be prejudiced by the alleged misconduct. Canadians have a right to demand that the IRB's processes are conducted in an ethical and fair manner. There is no tolerance for abuse of any kind in this institution. Since the IRB was created over 15 years ago, hundreds of decision-makers have issued to date approximately half a million decisions. We strive to maintain the highest ethical standards in order to protect the integrity of the IRB's processes. I am committed to ensure that the IRB will continue to be a model of fairness in the delivery of administrative justice in accordance with the law and Canada's international obligations.
