![]() IAD INNOVATIONThe Immigration Appeal Division (IAD) of the Immigration and Refugee Board of Canada (IRB) is undertaking a major initiative called IAD Innovation to re-examine and re-think how the IAD functions as an administrative tribunal. The IAD is facing an increasing volume of cases, with the prospect of even higher numbers in the future. IAD Innovation is about more than addressing this increase; it is also about making an investment in the long-term capacity of the IAD to deliver administrative justice simply, quickly and fairly to the people it serves. IAD Innovation will look at ways to transform the IAD into a less formal, less judicial forum that re-asserts the IAD as a tribunal, not a court. As an independent tribunal, the IAD has a direct and immediate obligation to improve the management of its caseload in order to meet the challenges ahead. The IAD is of the view that the most effective way to explore the full range of possibilities for change is to seek input from its own Members and staff, and from the parties and counsel who appear before it. The following questions are examples of the kinds of issues the IAD is examining in developing a plan for the transformation of its work:
There are many suggestions for improvement that can be considered. While the Board is open to all ideas, the focus is on transformative change rather than administrative adjustments. The initiative is looking at the development of new processes within the framework of the current legislation, as well as the precedents established by case law. Where the examination leads to ideas that can only be realized through a change in the law or the regulations, these will be noted for future consideration, should the law be revisited. The IAD has demonstrated its ability to respond to new challenges in the past. Its case management and ADR initiatives are tangible proof of this capacity. Through the IAD Innovation Project, we are confident that the IAD will continue to work with its stakeholders to build on its successes and meet the challenges now before it.
