Assessing the Effectiveness of Organized Crime Control Strategies: A Review of the Literature : Research Reports

Description: The purpose of this report is to examine studies and evaluations of strategies designed to combat organized crime. Overall, the review found that most of the evidence pertaining to the efficacy of organized crime control strategies is descriptive and anecdotal. Studies adopting sophisticated research designs are virtually non-existent. Nevertheless, the report highlights the challenges associated with the study of organized crime (e.g., lack of uniform definition of organized crime, paucity of data, etc.). It also describes 18 control strategies, including measures that range from regulation and legalization to tools available to prosecutors, law enforcement, and other public and private sector agencies. Finally, the report contains an assessment of the various strategies and their evaluations. In some cases, there were no data to help determine the effectiveness of the program; nonetheless, at least three of the 18 control measures can be considered (moderate to high) in effectiveness in combating organized crime.

Creating a Framework for the Wisdom of the Community: Review of Victim Services in Nunavut, Northwest and Yukon Territories : Research Reports

Description: Between January 2001 and August 2002 the Research and Statistics Division and the Policy Centre for Victim Issues undertook extensive consultation with victim service providers, community based service providers and government officials across the three territories. This project had a number of inter-related tasks and objectives. In addition to developing a comprehensive inventory of services currently available to victims of crime in Nunavut, the Northwest Territories and Yukon, the project also identified best practices, challenges, and gaps in delivery of victim services in the territories.
This report summarizes the findings from that consultation process and makes recommendations to address the issues raised. The recommendations are based on the experiences shared and the context of each territory.

Description: This report describes the development of a risk assessment tool to be used by criminal justice professionals in spousal abuse cases. The tool, called the Brief Spousal Assault Form for the Evaluation of Risk (B-SAFER), was developed and pilot tested with six police agencies in Canada, and in two jurisdictions in Sweden. The results of quantitative empirical analyses on Canadian and Swedish data are presented along with qualitative feedback received from police officers in Canada. Overall, the results were encouraging, suggesting that the B-SAFER tool includes relevant risk factors present in spousal assault cases and that the tool can be coded easily by police officers in the course of routine investigations.

Description: The purpose of this research project was to generate information about the conditional sentence of imprisonment, post-Proulx, from the perspective of the judiciary. More specifically, the research will explore a range of issues, including judicial reaction to proposed amendments to the conditional sentence regime by undertaking mini focus groups and interviews with appellate judges in Quebec, Ontario, and Manitoba. This research is important to the Department as it demonstrates a proactive approach. Furthermore, although judges are routinely consulted in other jurisdictions, this has not often happened in Canada.

Just Between You and Me: A Peer Public Legal Education and Information (PLEI) Programme for Women in Family Violence Situations : Research Reports

Description: The "Just Between You and Me" project was designed to provide Public Legal Education and Information (PLEI) peer support to women who had experienced family violence and assess its validity as a model for PLEI delivery. The goal of the project was that the peers would then share this information within their own networks of family, co-workers and communities, using resources already developed and existing in their areas. The study adapted an evaluation tool from earlier research (Broad, 2002), developed a recruitment tool and used materials already produced by other PLEI providers as the basis for the curriculum. A total of 18 women graduated from the eight-week training session, approximately one-half from the Indigenous communities. The findings of this study support peer development as a valid PLEI model of delivery. The participants, in their final self-assessment, identified substantial changes in the areas of knowledge growth, perception/ attitudinal and behaviour changes. Their comments indicate that they found the training empowering, and participants were already beginning to distribute the information through their community networks.

Description: In this issue of Just Research, some of the major policy research questions in the area of justice and the Canadian family are explored. Kelly Morton-Bourgon and Dr. Guy Bourgon examine the question of whether involving the family in the treatment of adolescent sexual offenders has an impact on treatment effectiveness. Dr. Cherami Wichmann presents a statistical profile of today's Canadian family using the most recent available data. Catherine Thomson provides an overview of recent research sponsored by the Department of Justice Canada on family transitions using data from the National Longitudinal Survey of Children and Youth. Jeff Latimer takes a critical look at Multisystemic Therapy as a response to serious youth delinquency that broadens the focus beyond the young person to the family as a whole. Marie Gannon and Karen Mihorean provide one of the first direct comparisons of sentencing outcomes between family violence convictions and other violent convictions in Canadian adult courts. Finally, Rick Gill and Dr. Cherami Wichman provide a brief summary of their recent work into shared parenting arrangements.

Description: The purpose of this exploratory study was to develop and test a method to undertake a review of organized crime prosecution files managed by the Federal Prosecution Service (FPS), Department of Justice Canada. In the absence of a uniform FPS definition of organized crime, the study method included the development of a definition by consulting with the FPS regional offices. The development of this definition was vital to this study and to future studies on organized crime prosecutions within the department. Using the pilot study definition of an organized crime file, the FPS regional offices each identified files for the pilot study review. The pilot study successfully reviewed 85 organized crime files from the Halifax, Montreal, Ottawa-Gatineau, Toronto, Edmonton, and Vancouver regional prosecution offices. The report contains the results of the file review, focusing on the nature of organized crime files and including the number and characteristics of the accused, the types of charges, and the outcomes. The study concludes that a more comprehensive review of a representative sample of files is possible using the organized crime definition developed for this study. Recommendations for consideration in the second phase of research are included.

Predicting Crime: A Review of the Research : Research Reports

Description: This report identifies and examines studies by leading justice organizations that have developped predictions about how crime will evolve over the next two decades in the West. Interviews were combined with a review of the electronic and printed literature and organization reports. The report finds that the rate of crime is expected to be quite stable with some increase as the proportion of youth in the population increases during the next decade (this is assuming that charging practices remain roughly the same). However, the nature and scope of crime has been changing and will continue to change with the impact of new technologies and the globalization of crime. While the substance of the crimes such as theft will remain the same the objects of theft and the location of the crime will change markedly.Â

Description: This report contains the results of a second wave of focus groups aimed at studying Canadians' views on the provisions of the Anti-Terrorism Act. In 2003, shortly after the enactment of Bill C 36, the views of ethnic minorities were canvassed on similar issues. This work was undertaken by the Research and Statistics Division of the Department of Justice Canada to help inform the mandated three-year Parliamentary review of the Anti-Terrorism Act. The firm Millward Brown Goldfarb was contracted to conduct 22 focus group sessions between February 2 and March 5, 2004, and analyze the results. Focus groups were conducted in Ottawa, Winnipeg, Montreal, Calgary, Regina, Vancouver, Quebec City, and Halifax. The results of these focus groups suggest that the Anti-Terrorism Act did not have a major impact on the lives of the participants in the study.

Description: This report examines the current legislative and judicial responses to plea bargaining within Canada and victim participation. The report also looks at the regulatory process for plea bargaining in the federal courts of the United States, with a specific focus on Arizona which provides for direct participation for the victim. Jurisprudence and empirical research on the victim impact statement are also examined. The report concludes with four potential models for victim participation in the plea bargaining process. This research was conducted on behalf of the Department of Justice Canada, Policy Centre for Victim Issues.

Description: This report analyzes the tension between victim privacy and the open court principle, especially in the context of sexual assault proceedings. It explains that the open court principle is one of the most highly prized values in the Anglo-Canadian common law tradition. The Views of Canadian Scholars on the Impact of the Anti-Terrorism Act : Research Reports

Description: This report compiled the views of Canadian scholars on the impact of the Anti-Terrorism Act, in preparation for the three year Parliamentary review of the legislation. In particular, the study asked participating scholars three specific questions: 1. What has been the impact of the Anti-Terrorism Act on Canada?; 2. What emerging trends in terrorism do you foresee and what threats do they pose to Canada? In discussing these trends and threats, please describe what you consider terrorism to be; 3. How should our country respond to these trends and threats? Please feel free to include measures at any level, such as social, economic, political, and legal, or a combination of these levels.
The report contains a synthesis of the 11 submissions written by participating scholars. The submissions themselves have been appended to the report. With respect to the impact of the Anti-Terrorism Act, scholars offered both positive and negative views. Some scholars noted that it is too early to gauge the impact of the Act. Others argued that the Act is a symbolic gesture and has had a negative impact on civil liberties and Canadian values. Still other scholars felt that the Act provides a deterrent effect and has enhanced both intelligence and prosecutions, with no detectable erosion of civil liberties.
