PUBLIC SAFETY ACT, 2002

Order Fixing April 20, 2005 as the Date of the Coming into Force of Certain Sections of the Act

P.C. 2005-616 April 19, 2005

Her Excellency the Governor General in Council, on the recommendation of the Minister of Natural Resources, pursuant to subsection 112(1) of the Public Safety Act, 2002, assented to on May 6, 2004, being chapter 15 of the Statutes of Canada, 2004, hereby fixes April 20, 2005 as the day on which sections 82 to 93 of that Act come into force.

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order fixes April 20, 2005, as the day on which sections 82 to 93 of the Public Safety Act, 2002 come into force. Those sections contain specific amendments to the National Energy Board Act to provide the National Energy Board (NEB) with a clear legislative authority for the security of pipelines and international power lines.

The amendments to the National Energy Board Act provide the NEB with a clear statutory mandate to

(a) order a pipeline company or certificate holder for an international power line to take measures to ensure the security of the pipeline or power line;

(b) make regulations respecting security matters;

(c) to ensure the confidentiality of information relating to security in its orders or proceedings;

(d) provide advice to the Minister of Natural Resources on issues related to the security of pipelines and international power lines; and

(e) waive the publication requirement for applications to export electricity, or to construct international power lines, if there is a critical shortage of electricity caused by terrorist activity.
