Bulletin No. 49-87 - Salary Protection Policy Interpretation Applicable tothe Reclassification or Conversion Regulations and PSAC/PIPS Memoranda ofUnderstanding

 

The PAM is being amended to include an updated section on the Regulations Respecting Pay on Reclassification or Conversion.  Since Bulletin 49-87 is still in effect, it is being included on the TB site as a supporting document to the examples in the section on reclassification and conversion.

SUBJECT: Salary Protection Policy Interpretation Applicable to the Reclassification or Conversion Regulations and PSAC/PIPS Memoranda of Understanding

  1. The purpose of this bulletin is to clarify the application of the expression "deemed to have retained for all purposes the former group and level" as contained in paragraph 4, Part 1A of the Regulations Respecting Pay on Reclassification or Conversion and in many of the Memoranda of Understanding on the subject.
  2. Where the position is:
    1. reclassified or converted to a group and/or level having a lower attainable maximum rate of pay, and
    2. represented by the same bargaining agent both before and after downgrading, and
    3. subject to a Memorandum of Understanding providing salary protection and containing the phrase "for all purposes,"

    the incumbent of the position retains the rates of pay and all other terms and conditions of employment applicable to the higher group and/or level.

  3. In all other situations, on reclassification or conversion to a group and/or level having a lower maximum rate of pay, the expression "for all purposes" is applicable to the rates of pay only.
