SUBJECT: Financial penalties
The purpose of this document is to
provide you with information regarding the imposition of fines or special levies
on employees who are bargaining agent members.
Lately we have received numerous inquiries from both employees
and departmental personnel units questioning the legality that bargaining agent
members, including designated employees, are being advised by their bargaining
agent that they are subject to fines or special levies if they cross the picket
line and report for work.
Access by bargaining agents to the Government's pay system that
is operated by Public Works and Government Services Canada (PWGSC) is limited to
the recovery of monies for membership dues. The recovery of fines or special
levies is an administrative matter for the bargaining agents to deal with
internally. The Treasury Board Secretariat (TBS) will not be party to any
recovery of such levy or fines imposed by the bargaining agents from employees'
pay cheques and through the check-off procedure.
Officials of both TBS and PWGSC will be closely monitoring the
dues input submitted by the bargaining agents to the pay system through the
check-off procedure. Any changes that are not within the established norms will
be stopped, thoroughly investigated and appropriate remedial action taken.
Departmental compensation and staff relations managers should
direct any questions that they may have to their appropriate corporate officials
who, if need be, can contact the Pay Administration Section.
