KNOW ALL PERSONS BY THESE PRESENTS that
I, ___________________, of __________________________; (check one
of the following):
___ for myself and my heirs,
executors, administrators, successors and assigns,
___ on behalf of, _____________________________ in capacity
of __________________________, [state capacity],
in consideration of the receipt of the sum of
$___________ paid to me pursuant to the provisions of the
Memorandum of Agreement dated the 29th day of
October, 1999, and made between the Public Service Alliance of
Canada (PSAC) and Treasury Board:
- do remise, release and forever
discharge Her Majesty the Queen in right of Canada, from all
past, present and future claims, demands, costs, damages, debts,
sums of money, actions, suits or proceedings of any nature
whatsoever, whether ascertained or unascertained and whether at
law or in equity, relating to the period December 19, 1984 to
October 29, 1999, inclusive, and forming the basis of or arising
out of the complaints filed by PSAC with the Canadian Human
Rights Commission on December 19, 1984 and February 16, 1990 (the
"Complaints");
- agree not to take any further actions
or advance any further claims before the Canadian Human Rights
Commission in respect of any matter arising out of the
Complaints;
- declare that I understand that I have
the right to consult independent legal counsel in connection with
matters arising out of the Complaint and that I am voluntarily
executing this release for the purposes of settling all claims
which I may have arising out of the Complaints; and
- declare that I understand that by signing this Release I am
agreeing not to file a separate complaint or to make a claim
through any other action or proceeding, nor to authorize any
other person or organization to do so on my behalf, against Her
Majesty, or against any other person, corporation or entity which
might claim a contribution or indemnity from Her Majesty, in
relation to the matters covered by this Release.
