Prior Informed Consent (PIC) Regulations
and Order under CEPA, 1999
The Rotterdam Convention on the Prior Informed
Consent (PIC) Procedure for Certain Hazardous Chemicals and Pesticides in
International Trade aims to provide an efficient method for exchanging
information about a small number of banned or severely restricted industrial
chemicals and pesticides between participating countries.
The Convention
is not a worldwide ban on certain chemicals. Rather, it will require that
identified chemicals not be exported unless prior consent has been provided by
the government of the importing country. Under the Convention, exporting
countries will also be legally bound to inform importing countries about
exports of chemicals banned or severely restricted in the exporting country.
Countries that ratify the Convention will be obliged to implement the agreement
at the national level and to create enforcement mechanisms to control
commercial exports and exporters.

The Export of Substances Under the Rotterdam Convention Regulations

were published in Canada Gazette, Part II on August 28, 2002. These regulations
apply to pesticides that are subject to the Rotterdam Convention

The Order Amending Schedule 3 to the Canadian Environmental Protection Act, 1999 makes the following four pesticides
subject to the Regulations: toxaphene, binapacryl, ethylene dichloride and
ethylene oxide. Participating countries recently agreed to add these substances
to the PIC procedure of the Rotterdam Convention.
