Aboriginal and Treaty Rights in the Maritimes: The Marshall Decision and Beyond
Abstract |
Thomas Isaac reviews Aboriginal law in Canada, and then addresses many important issues in the Maritimes, including logging and fishing rights; reserve lands; and the import of the treaties of peace and friendship entered into between the area's First Nations and the Crown. Of particular importance to this analysis is the Marshall decision in which, the author argues, the SCC went beyond its previous decisions not only by liberally interpreting the treaty but by adding rights not specifically mentioned in it. While this book focuses on the Maritimes, much of the analysis applies to and will be of interest across Canada.
