PSETL-Employment Standards

The Employment Standards Branch is responsible for promoting, overseeing and enforcing the application of New Brunswick's Employment Standards Act and accompanying Regulations. The legislation provides for standards of work that apply, as a minimum, to all employee-employer relationships in the province. These standards address minimum wage, hours of work, vacation time and pay, public holiday pay, termination notice and pay in lieu thereof, maternity leave, child care leave, sick leave, family responsibility leave, court leave, bereavement leave, employment of children, unfair employer action, weekly rest period, equal pay for equal work, minimum reporting wage, prompt payment of wages and wage protection.

As a neutral party, the Employment Standards Branch provides comprehensive services to both employees and employers, including responding to general inquiries, investigating complaints, enforcing provisions of the Act and Regulations, and proactively providing educational and information services to the public.

Summary

The core programs/services provided by the Employment Standards Branch include:

  • Enforcement of the Employment Standards Act and accompanying Regulations.
  • Investigation of complaints.
  • Performing audits to ensure compliance with the legislation.
  • Providing employers and employees recourse before a designated objective body leading to final and binding decision in writing.
  • Informing employer and employee groups of their rights, obligations and benefits.
  • Promoting voluntary compliance to regulated standards.

As of January 1st, 2006, the minimum wage is $6.50 per hour.

As of July 1st, 2006: $6.70 per hour.
