An Act to amend the Employment Insurance

enacts as follows:

1. (1) The definition “waiting
period” in subsection 6(1) of the Employment Insuran-ce Act is
repealed.
|
|

(2) The definition “disentitled” in sub-section 6(1)
of the Act is replaced by the following:

Deduction for excluded days
|
20. If a claimant is disentitled from receiv-ing benefits for a
working day in a week of unemployment, an amount equal to 1/5 of their weekly
rate of benefits for each such working day shall be deducted from the
benefits payable for that week.
|

jours ouvrables de la semaine de chômage, il est déduit des prestations

5. Subsection 22(4) of the Act is
repealed.

When
disqualification is to be served
|
(2)
Subject to subsections (3) to (5), the weeks of disqualification are to be
served during the weeks for which benefits would otherwise be payable if the
disqualification had not been imposed and, for greater certainty, the length
of the disqualification is not affected by any subsequent loss of employment
by the claimant during the benefit period.

(2) Sous
réserve des paragraphes (3) à (5), l’exclusion doit être purgée au cours des
semaines de la période de prestations du prestataire pour lesquelles il
aurait sans cela droit à des prestations. Il demeure par ailleurs entendu que
la durée de cette exclusion n’est pas touchée par la perte subséquente d’un
emploi au cours de la période de prestations.

9. Subsection 30(2) of the Act is
replaced by the following:

Length of disqualification
|
(2) The disqualification is for each
week of the claimant’s benefit period and, for greater certainty, the length
of the disqualification is not affected by any subsequent loss of employment
by the claimant during the benefit period.

semaines de la période de prestations du prestataire. Il demeure par ailleurs
entendu que la durée de cette exclusion n’est pas affectée par la perte

10. Paragraph 54(a) of the
Act is repealed.

11. Section 67 of the Act is
renumbered as subsection 67(1) and is amended by adding the following:

Repayment of premium
|
(2) Any premium paid by a person under
subsection (1) shall be repaid to the person if the person makes an
application for benefits that is denied because the person
(a) has
not worked a sufficient number of hours during the qualifying period as
described in paragraph 7(2)(b) in order to qualify for benefits;
(b) was
not capable of and available for work during all or part of the qualifying
period as a result of being in attendance at a course or program of
instruction or training; or
(c) was,
for all or part of the person’s employment during the qualifying period,
self-employed.

(2) La personne qui a versé une cotisation
aux termes du paragraphe (1) est remboursée si sa demande de prestations est
refusée pour l’une ou l’autre des raisons suivantes :
a) elle n’a pas travaillé le nombre d’heures d’emploi assurable
requis au titre de l’alinéa 7(2)b);
b)
elle n’était pas capable de travailler ni disponible à cette fin pendant tout
ou partie de la période de référence parce qu’elle suivait un cours ou
programme d’instruction ou de formation;
c) elle était un travailleur indépendant pendant tout ou partie de
la période de référence.

12. Section 68 of the Act is
renumbered as subsection 68(1) and is amended by adding the following:

Repayment of premium
|
(2) Where a person is repaid a premium
under subsection 67(2), any corresponding premium that was paid by the
person’s employer under subsection (1) shall be repaid to the employer.

remboursée conformément au paragraphe 67(2) lui est remboursée.

13. Section 82 of the Act is
amended by adding the following after subsection (2):

No remittance by employer
|
(2.1) The employer shall not remit any
amount to the Receiver General on account of the employer’s premium in
respect of the insurable earnings of a person for a year if the insurable
earnings paid by all employers to that person for that year have reached the
maximum yearly insurable earnings for that person.
|

14. Section 96 of the Act is
amended by adding the following after subsection (3):

Excess amount
|
(3.1) For the purposes of subsection
(3), any amount of employer’s premiums paid during a year by an employer with
respect to a person after the maximum amount has been deducted from that
person’s total insurable earnings for the year shall be considered as an
amount in excess of the amount required to be paid for that year by that
employer with respect to that person.
|

(3.1) Pour l’application du paragraphe
(3), toute partie de la cotisation patronale versée par un employeur au cours
d’une année à l’égard d’une personne après que le montant maximum ait été
déduit de la rémunération annuelle assurable totale de celle-ci est
