An Act to amend the
Corrections and Conditional Release Act (indictable offence committed while

1. Subsection 139(1) of the Corrections
and Conditional Release Act is replaced by the following:
|

Additional sentences
|
139. (1) For the purposes of the Criminal Code,
the Prisons and Reformatories Act and this Act, where a person who is
subject to a sentence that has not expired receives an additional sentence as
a result of a conviction for an indictable offence, the person shall serve the
remainder of the original sentence and at least two-thirds of the additional
sentence before becoming eligible for conditional release.

139. (1) Pour
l’application du Code criminel, de la Loi sur les prisons et
les maisons de correction et de la présente loi, l’individu assujetti à
une peine d’empri-sonnement non encore expirée qui est condamné à une peine
d’emprisonnement supplémentaire du fait qu’il est reconnu coupable d’un acte
criminel doit purger le reste de la peine initiale et au moins les deux tiers
de la peine supplémentaire avant d’être admissible à la mise en liberté sous

imposed.

2. The Act is amended by adding the
following after section 139:

More than one
conviction while on conditional release
|
139.1 (1) Where a person has
been convicted a second or subsequent time of an indictable offence that was
committed while the person was on conditional release, the person is not
eligible for conditional release in respect of a sentence imposed as a result
of that conviction.
|
|
139.1 (1) L’individu qui, à plus d’une reprise, a été reconnu coupable

Sentence in community facility
|
(2) The person referred to in subsection (1) shall serve an
additional ninety-day sentence in a community-based residential facility
follow-ing the expiration of the sentence referred to in that subsection.

purge une peine supplémentaire de quatre-vingt-dix jours dans un
établissement résidentiel communautaire.
