Her Majesty, by and with the advice and
consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 163.1 of the Criminal
Code is amended by adding the following after subsection (4):
|

criminel est modifié par adjonction, après le paragraphe (4), de ce qui
suit :

Child pornography created by accused
|
(4.01) Every person who possesses any
child pornography that was created by the person or obtained from another
source and who permits any other person to have access to it by any means or
fails to take reasonable steps to ensure that it is at all times kept in such
a way as to prevent any other person from obtaining access to it, in whole or
in part,
(a) is guilty of an indictable
offence and liable to imprisonment for a term not exceeding five years; or
(b) is guilty of an offence
punishable on summary conviction.

(4.01) Quiconque a en sa possession de
la pornographie juvénile réalisée par lui-même ou obtenue d’une autre source
et soit permet à une autre personne d’y avoir accès par quelque moyen, soit
néglige de prendre des mesures raisonnables pour empêcher une autre personne
d’y avoir accès, en tout ou en partie, est coupable :
a) soit
d’un acte criminel passible d’un emprisonnement maximal de cinq ans;
b) soit
d’une infraction punissable sur déclaration de culpabilité par procédure
sommaire.

Reasonable steps
|
(4.02) For the purposes of subsection
(4.01), the reasonable steps are those that would be normal for a prudent
person to take to prevent any other person from obtaining access to the child
pornography by accident or by any means that constitutes an offence under
this Act.

(4.02) Pour l’application du paragraphe
(4.01), les mesures raisonnables sont celles que prendrait normalement une personne
prudente pour empêcher une autre personne d’avoir accès à la pornographie
juvénile acciden-tellement ou d’une manière qui constitue une infraction aux
termes de la présente loi.
