1. Section 2 of the Special Economic
Measures Act is amended by adding the following in alphabetical order:
“Committee” means the standing committee of the House of Commons
appointed to consider matters related to foreign affairs;
“U.N. Declaration” means the United Nations Declaration on the
Elimination of All Forms of Intolerance and of Discrimination Based on
Religion or Belief, adopted by the General Assembly on November 25, 1981.

2. Section 4
of the Act is amended by adding the following after subsection (2):

Committee report
|
(2.1) The
Committee may make a report to the House of Commons recommending
(a) that a foreign state be named
as a state that does not permit religious freedom, and that no public money
of Canada be used to fund or guarantee any activity mentioned in subsection
(2) in relation to that foreign state;
(b)
that a foreign state named under paragraph (a) be no longer so named
and that restrictions on the use of the public money of Canada to fund or
guarantee any activity mentioned in subsection (2) in relation to that
foreign state be removed; or
(c)
that an exemption from the consequen-ces of being named under paragraph (a)
or of being no longer named under paragraph (b), including an
exemption respecting any person, property, good, technical data, service,
transaction, ship or aircraft, or any class thereof, be applied, removed or
varied.

(2.1) Le Comité peut présenter à
la Chambre des Communes un rapport recommandant :
a) de désigner un État étranger
comme État n’accordant pas la liberté de religion et d’interdire que soient
utilisés des fonds publics canadiens pour financer une activité mentionnée au
paragraphe (2) à l’égard de cet État, ou pour en assurer la réalisation;
b) d’annuler la désignation et de lever les
restrictions visées à l’alinéa a) à l’égard d’un État étranger;
c) d’appliquer, de supprimer ou de modifier
une dérogation aux conséquences de la désignation visée à l’alinéa a)
ou de l’annulation de désignation visée à l’alinéa b), notamment à
l’égard de personnes, biens, marchandises, données techniques, services,
opérations, navires ou aéronefs déterminés ou de certaines catégories
déterminées de ceux-ci.

(2.2) The Committee, in considering whether or not to
name a foreign state in a report as a state that does not permit religious
freedom, shall consider, in addition to any other information or evidence
that is presented to it,
(a) the terms of the U.N.
Declaration; and
(b) any evidence or representation
that the Minister of Foreign Affairs may make to the Committee.

(2.2)
Lorsqu’il étudie l’opportunité de désigner dans son rapport un État étranger
comme État n’accordant pas la liberté de religion, le Comité tient compte,
outre tout autre renseignement ou preuve qui lui est présenté :
a) de la Déclaration des Nations
Unies;
b) de toute preuve ou observation
que lui soumet le ministre des Affaires étrangères.

Governor
in Council to give effect to resolution concurring in report
|
(2.3) If the House of Commons passes a resolution to
concur in, or amend and concur in, a report made by the Committee under
subsection (2.1), the Governor in Council shall forthwith make such orders or
regulations with respect to any of the activities referred to in subsection
(2) in relation to the foreign state named in the report as are necessary to
give effect to the provisions of the report concurred in.

(2.3)
Sur adoption, par la Chambre des communes, d’une résolution adoptant le
rapport — avec ou sans modifications —, le gouverneur en conseil prend, dans
la mesure nécessaire à l’application du rapport, un décret ou un règlement
sur l’une ou l’autre des activités mentionnées au paragraphe (2) à l’égard de
l’État visé.
