An
Act to recognize the injustices done to Chinese immigrants by head taxes and
exclusion legislation, to provide for recognition of the extraordinary
contribution they made to Canada, and to provide for restitution which is to
be applied to education on Chinese Canadian history and the promotion of
racial harmony

Preamble
|
Whereas workers of Chinese origin
made an extraordinary contribution in the building of the Canadian nation,
particularly in the construction of the railways, and many of them died
during their construction;
Whereas, despite the contribution of early Chinese workers,
Chinese immigrants were unjustly and uniquely assessed a head tax prior to
1923;
Whereas Chinese were later discriminated against on the
basis of ethnic origin by The Chinese Immigration Act, 1923;
And Whereas
it is necessary and timely for public recognition of these injustices and
appropriate restitution to be made in the form of public education;
Now,
Therefore, Her Majesty, by and with the advice and
consent of the Senate and House of Commons of Canada, enacts as follows:

que les
travailleurs d’origine chinoise ont contribué de façon remarquable à bâtir le
Canada, notamment en participant à la construction de ses chemins de fer, et
que beaucoup d’entre eux sont morts pendant ces travaux;
que,
malgré la contribution des premiers travailleurs chinois, les immigrants
chinois étaient, avant 1923, injustement frappés d’une taxe d’entrée que nul
autre groupe ethnique n’avait à payer;
que la Loi
de l’immigration chinoise, 1923 a ensuite imposé des mesures discriminatoires
à l’égard des Chinois en raison de leur origine ethnique;
qu’il est
nécessaire et opportun de reconnaître publiquement ces injustices et de
prévoir une indemnisation convenable sous forme de projets d’éducation
publique,

1. This Act may be cited as the Chinese Canadian Recognition and
Restitution Act.

2. The Parliament of Canada hereby recognizes and honours the
contribution of Chinese immigrants, particularly in the construction of the
Canadian railways.

3. The Parliament of Canada hereby acknowledges the unjust treatment of
Chinese Canadians as a result of the head tax and The Chinese
Immigration Act, 1923 and, on behalf of Parliament, the Government of
Canada and the Canadian people of earlier times and of today, apologizes for
the suffering it caused.

3. Le Parlement du Canada reconnaît le traitement injuste qu’ont
subi les Canadiens d’origine chinoise par suite de l’imposition d’une taxe
d’entrée et de l’adoption de la Loi de l’immigration chinoise, 1923 et
présente, en son nom et au nom du gouvernement du Canada et du peuple
canadien d’hier et d’aujourd’hui, ses excuses pour les souffrances causées
par ce traitement.

4. (1) The Minister of Canadian Heritage, in cooperation with the
Minister of Finance, shall negotiate with the National Congress of Chinese
Canadians a suitable payment in restitution for the collection of money from
Chinese immigrants as head tax, to be proposed to Parliament for its
approval.

4. (1) Le ministre du Patrimoine canadien, en collaboration avec le
ministre des Finances, négocie avec le National Congress of Chinese Canadians
une entente fixant une indemni-sation convenable en dédommagement des sommes
perçues des immigrants chinois à titre de taxe d’entrée, en vue de sa
présentation au Parlement pour son approbation.

Application of restitution

(2) The restitution payment shall be applied to
(a) the establishment, in the
manner agreed between the parties mentioned in subsection (1), of an
educational foundation that shall have as its object the development and
production of educational materials on Chinese Canadian history and on the
promotion of racial harmony, and their distribution to schools, colleges and
univer-sities; and
(b) such other educational
projects as are agreed to and are established in the manner agreed to between
the Minister of Canadian Heritage and
the foundation.

L’indemnisation sert à financer :
a) l’établissement, selon les
modalités convenues par les parties mentionées au paragraphe (1), d’une
fondation éducative dont l’objet est la conception et la production de
matériel éducatif sur l’histoire des Canadiens d’origine chinoise et la
promotion de l’harmonie raciale, ainsi que sa distribution aux écoles,
collèges et universités;
b) les autres projets éducatifs sur
lesquels s’entendent le ministre du Patrimoine canadien et la fondation, qui
sont établis selon les modalités dont ils conviennent.
