1. Subsection 3(3) of the Employment Insurance Act is
replaced by the following:

(2.1) The Commission shall,
within fifteen days after the end of every quarter of a fiscal year, prepare
and submit to the Minister a report that states whether the amounts credited
to and debited from the Employment Insurance Account are, in the opinion of
the Commission, likely to cause the surplus in the Account to exceed the
upper limit established by subsection 66.2(1) or fall below the lower limit
established by subsection 66.2(2) during the remainder of the fiscal year
and, if so, whether it intends to adjust the premium rate in accordance with
subsection 66.2(4).

(2.1) Dans les quinze jours suivant la fin de
chaque trimestre d’exercice, la Commission établit et remet au ministre un
rapport indiquant si, à son avis, les montants portés au crédit et au débit
du Compte d’assurance-emploi vont vraisemblablement entraîner dans ce Compte,

(2.2) The officer of the Department of Human Resources
Development designated by the Minister as chief actuary of the Department
shall, before the commencement of
every fiscal year, and may, on any other occasion when the chief
actuary considers it necessary, submit a report to the Minister stating, with
respect to the surplus in the Employment Insurance Account,
(a) the
upper limit of surplus that should be allowed at any time to ensure that the
premium rate is not unnecessarily high; and
(b)
the lower limit of surplus that should be allowed at any time to ensure the
continuing ability to make the payments required by this Act from the
Account.

(2.2) Le fonctionnaire du ministère du Développement
des ressources humaines désigné par le ministre comme actuaire en chef du
ministère doit, avant le début de chaque exercice, et peut, à tout moment

(3) The Minister shall cause each report received under subsections
(2), (2.1) and (2.2) to be laid before each House of Parliament within ten days after receiving it or, if the House is not then
sitting, on any of the first five days on which the House is sitting after the
report is received.

2. Section 66 of the Act is amended by
striking out the word “and” at the end of paragraph (a), by adding the
word “and” at the end of paragraph (b) and by adding the following
after paragraph (b):
(c) so
far as is reasonably foreseeable, ensure that the surplus in the Account will
not rise above the upper limit established by subsection 66.2(1) nor fall
below the lower limit established by subsection 66.2(2).

3. The Act is amended by adding the following after section 66.1:

66.2 (1) In setting the premium rate for each year, the Commission shall,
to the extent possible, and subject to subsection (3), ensure that the
surplus in the Employment Insurance Account shall not exceed an upper limit
of
(a)
fifteen billion dollars; or
(b) such
other amount as is set by the Commission with the approval of the Governor in
Council on the recommendation of the Minister and the Minister of Finance.

66.2 (1) Sous réserve du paragraphe

(3) The
Commission shall set upper or lower limits for the purposes of paragraph (1)(b)
or (2)(b) that will prevent excessive or insufficient amounts of money
being held in the Employment Insurance Account, considering the purposes of
the Account, and, in setting the limits, shall consider
(a)
current economic conditions;
(b)
reasonably anticipated changes in economic conditions;
(c)
seasonal variations in employment;
(d)
any report made under subsection 3(2.2); and
(e)
any recommendation made on such a report by a committee mentioned in
subsection 3(4) that has been concurred in by the House of Commons.

(3) La Commission fixe les limites
maximum et minimum visées aux alinéas (1)b) et (2)b) de façon à
éviter que le montant du Compte d’assurance-emploi soit excessif ou
insuffisant pour son objet, en tenant compte des éléments suivants :

(4) The
Commission may adjust the premium rate during a fiscal year if the Commission considers that
(a) the surplus in the Employment
Insurance Account is likely to
(i) exceed the upper limit set under subsection (1)
for a part of the fiscal year by an amount that the Commission considers
unnecessary having regard to the obligations of the Account, or
(ii) fall below the limit set under subsection (3)
for a part of the fiscal year to an extent that the Commission considers to
be imprudent having regard to the obligations of the Account; and
(b) an adjustment during a fiscal
year will not cause the government, employers or employees unwarranted administrative
expense.

(4) La Commission peut modifier le
taux de cotisation en cours d’exercice si elle est
d’avis :
a) que le surplus du Compte
d’assurance-emploi est susceptible :
(i)
d’être supérieur, pour une partie de l’exercice, à la limite maximum établie
aux termes du paragraphe (1) d’un montant qu’elle ne juge pas nécessaire
compte tenu des obligations liées au Compte,
(ii)
d’être inférieur, pour une partie de l’exercice, à la limite minimum établie
aux termes du paragraphe (3) dans une mesure qu’elle juge imprudente compte
tenu des obligations liées au Compte;
b) qu’une modification en cours
d’exercice n’entraînera pas de frais administratifs injustifiés pour le
gouvernement, les employeurs ou les employés.
