Performance representations

When making representations to the public about the performance, efficacy or length of life of a product, paragraph 74.01(1)(b) of the Competition Act requires that these representations be based on adequate and proper tests.

Performance claims that raise a question under the Act fall into two broad categories: those that are inappropriate in relation to the actual test results and those that are based on poorly designed test methodologies. Refer to the Performance representations not based on adequate and proper tests section for additional details.
