ASSISTED HUMAN REPRODUCTION ACT

Order Fixing January 12, 2006 as the Date of the Coming into Force of Certain Sections of the Act

Her Excellency the Governor General in Council, on the recommendation of the Prime Minister, pursuant to section 78 of the Assisted Human Reproduction Act, assented to on March 29, 2004, being chapter 2 of the Statutes of Canada, 2004, hereby fixes January 12, 2006 as the day on which sections 21 to 39, 72, 74, 75 and 77 of that Act come into force, other than paragraphs 24(1)(a), (e) and (g).

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order fixes January 12, 2006 as the day on which sections 21 to 39, 72, 74, 75 and 77 of the Assisted Human Reproduction Act (the "Act") come into force, other than paragraphs 24(1)(a), (e) and (g).

The Act prohibits assisted reproduction procedures that are considered to be ethically unacceptable. Other types of assisted reproduction procedures are prohibited unless carried out in accordance with a licence and the regulations, which will address health and safety concerns. The creation and use of embryos for research purposes is also addressed. A privacy regime governs the collection, use and disclosure of health reporting information.

Sections 21 to 39 of the Act establish the Assisted Human Reproduction Agency of Canada and provide for its mandate. The Agency will provide advice to the Minister of Health on the matters governed by the Act. The provisions of the Act relating to the Agency's mandate concerning the issuance and review of licences, the collection and analysis of health reporting information, inspections and the enforcement of the Act will come into force at a later date.

Sections 72, 74, 75 and 77 of the Act contain consequential amendments.
