Do I
have to register in your jurisdiction?
If you employ workers or carry on business in the Northwest
Territories or Nunavut, you must register with the WCB regardless of
your home jurisdiction.
All employers who carry on business in the Northwest
Territories or Nunavut, even temporarily, must register with the WCB
within 10 days of commencing operation.
Even if you do not employ workers, you will need a
certificate of compliance from the WCB in order to obtain a business
license. (Nunavut Only)
No industries are exempt from WCB requirements.

How
do I register?
To register your company with the WCB, you will need to
complete an Employer Account Registration Form, which you can download
as a PDF document. Fax the completed form to (867) 873-4596.
You will need to provide details of your business operation,
together with an estimate of your assessable payroll for the upcoming
calendar year. With this information, the WCB will establish an
account and you will be issued a notice of assessment.

Do I qualify for coverage?
All workers in the Northwest Territories
and Nunavut, not including federal government employees, are
automatically covered by the Workers' Compensation Acts.
Included are those who have entered into, or work under, a contract of
service or apprenticeship, written or oral, expressed or implied.
You are not considered to be a worker under the Workers'
Compensation Acts if you are:

- an executive officer in a position to guide
or control the policies and purposes of a corporation;
- in business or partnership practicing as a
member of the legal, medical, accounting, actuarial, dental,
pharmaceutical, architectural, engineering or similar
profession;
- an employer or independent operator; or
- a family member who is employed by and
living with any person mentioned above.

Can I obtain coverage even if I'm not
considered a worker?
Yes, by applying to the WCB for Personal Optional Coverage. This
coverage can be purchased for a minimum of one month and, once
approved, is effective the day your application is received in our
office. Your benefits will be based on the amount of coverage
requested and accepted. Coverage must be renewed annually.
On approval of your application, you will be
entitled to the protections of the Acts and all their benefits. See the Business Operator Qualifications

What should I do if I am hiring sub-contractors?
If you are a principal contractor you
are legally liable for WCB assessments of the labour portion of each
contract with contractors or sub-contractors who perform work for you.
Subcontractors can also be deemed
workers.
All contracts that include
any labour must have final clearances to release the principal
contractor of their liability. Clearances
are not required for contracts of equipment or materials, unless
labour is supplied with the equipment or material (e.g. a contract to
lease a dump truck may include the driver, this would require a
clearance).
The WCB can provide you with a
letter of clearance confirming that your contractor or sub-contractor
is in good standing with the Board. As the principal, you are required to withhold payments until
you receive this letter.
To request a letter of clearance,
complete the Request for Clearance Form and forward it to your Customer Service Representative at (867) 873-4596. The WCB will
respond to your request.
